INTERGOVERNMENTAL VACATION ORDINANCE




WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) ofthe 1970 Constitution ofthe State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and



WHEREAS, the Board of Trustees of Community College district No. 508, County of Cook and State of Illinois (the "Board"), pursuant to that certain quitclaim deed dated January 9, 2018, and recorded with the Office of the Recorder of Deeds of Cook County, Illinois, on January 30, 2018, as document number 1803045018, conveyed to the City certain property, including approximately 12.2 acres of vacant land on the west side of Wentworth Avenue that is bounded by Marquette Road on the north, 69th Street on the south, Wentworth Avenue on the east, and the Northeast Illinois Regional Commuter Railroad Corporation (doing business as Metra) train tracks on the west (such described property, the "Future 2FM Facility Site"); and



WHEREAS, the Department of Planning and Development proposes to assemble the Future 2FM Facility Site including the portion of the public right of way to be vacated pursuant to this ordinance for the establishment of a new vehicle maintenance and fueling facility for the Department of Fleet and Facility Management; and



WHEREAS, the City Council of the City, after due investigation and consideration, has determined that the nature and extent of public use and the public interest to be subserved is such as to warrant'the vacation of that part of the public right of way described in this ordinance; now, therefore,



BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:



SECTION 1. Legal Description



A TRACT OF LAND 40.00 FEET IN WIDTH IN BLOCK 1 IN NORMAL SCHOOL SUBDIVISION OF THE WEST 1/2 OF THE SOUTHEAST 1/4 OF SECTION 21, TOWNSHIP 38 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN, RECORDED NOVEMBER 18, 1871 AS DOCUMENT 3284, THE NORTH LINE OF SAID TRACT OF LAND BEING A LINE DRAWN 314.00 FEET (MEASURED PERPENDICULARLY) SOUTH OF AND PARALLEL WITH THE NORTH LINE OF SAID BLOCK 1; THE EAST LINE OF SAID TRACT OF LAND BEING A LINE DRAWN 6.50 FEET WEST OF AND PARALLEL WITH THE EAST

LINE OF SAID BLOCK, AND THE WEST LINE THEREOF BEING A LINE DRAWN 1.00 FOOT EAST OF AND PARALLEL WITH THE WEST LINE OF SAID BLOCK, TOGETHER WITH ALL THAT PART OF THE WEST 1.00 FOOT OF LOT 9 IN BLOCK 1 AFORESAID, LYING WITHIN A STRIP OF LAND 40.00 FEET IN WIDTH, THE CENTER LINE OF WHICH IS 334.00 FEET SOUTH OF THE NORTH LINE OF BLOCK 1 AFORESAID, ALL IN COOK COUNTY, ILLINOIS, AN AREA OF 10,380 SQUARE FEET OR 0.2383 ACRES MORE OR LESS, as shaded and legally described by the words "HEREBY VACATED" on the plat hereto attached as Exhibit A, which drawings for greater clarity are hereby made a part of this ordinance, be and the same is hereby vacated and closed, inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation.



SECTION 2. The City hereby reserves an easement over the entire width and length of the area herein vacated, with a minimum clearance to forty (40) feet above grade, for existing Department of Water Management sewer and associated sewer structures, and for the installation of any additional sewers, as now located, or which in the future may be located in the street herein vacated, and for the maintenance, renewal and reconstruction of such facilities. It is also provided that, the City shall have 24 hour access to the area to be vacated, that no buildings, permanent structures, or trees (within 10 feet of the sewer structure) shall be erected upon or over said easement herein reserved, or other use made of said area, which in the sole discretion of the respective municipal officials having control of the aforesaid service facilities, would interfere with the use, maintenance, renewal, or reconstruction of said facilities, or the construction of additional municipally-owned service facilities. All proposed plans for improvements must be submitted to and approved by the Department of Water Management -Sewer Section prior to construction. It is further provided that the expenses related to any vacation-beneficiary prompted adjustments to City sewer facilities within the area herein vacated be borne by the beneficiary department, its successors or assigns, and said proposed adjustments be submitted to the Department of Water Management for review and express written approval prior to construction. Any repair, renewal' or replacement of private improvements, or private property damaged within the vacation area as a result of the City exercising its easement rights shall be repaired/replaced at the expense of the beneficiary department, its successors or assigns.



SECTION 3. The vacation herein provided for is made upon the express condition that within one hundred eighty (180) days after the passage of this ordinance, the Department of Planning and Development or its assign shall file or cause to be filed for recordation with the Office of the Recorder of Deeds of Cook County, Illinois, a certified copy of this ordinance, together with the associated full sized plat as approved by the Department of Transportation's Acting Superintendent of Maps and Plats.



SECTION 4. This ordinance shall take effect and be in force from and after its passage and approval. The vacation shall take effect and be in force from and after recording of the approved ordinance and the associated full sized plat of vacation as approved by the Acting Superintendent of Maps and Plats.
