COMMERCIAL ORDINANCE
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 Constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the properties at 2422-2454 N. Elston Avenue and 2004-2050 W. Fullerton Avenue are owned by TCA-2020 West, L.L.C., an Illinois limited liability company ("Developer"); and
WHEREAS, the Developer proposes to use the portion of the street remnant to be vacated herein for a surface parking lot; and
WHEREAS, the City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of that portion of the public street remnant, described in the following ordinance; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1.
VACATION:
THAT PART OF THE SOUTHWEST QUARTER OF SECTION 30, TOWNSHIP 40 NORTH, RANGE 14, EAST OF THE THIRD PRINCIPAL MERIDIAN, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE MOST SOUTHERN SOUTHEAST CORNER OF LOT 1 IN SNOW ESTATE SUBDIVISION, RECORDED FEBRUARY 14,1873 IN COOK COUNTY AS DOCUMENT NUMBER 80819; THENCE SOUTHEASTERLY ALONG THE EXISTING NORTHEASTERLY RIGHT OF WAY LINE OF N. ELSTON AVENUE ON AN ASSUMED BEARING OF SOUTH 46 DEGREES 15 MINUTES 46 SECONDS EAST, 275.04 FEET TO THE POINT OF BEGINNING; THENCE CONTINUING SOUTH 46 DEGREES 15 MINUTES 46 SECONDS EAST ALONG SAID LINE, 38.03 FEET; THENCE NORTH 65 DEGREES 16 MINUTES 05 SECONDS EAST, 15.51 FEET; THENCE SOUTH 1 DEGREE 31 MINUTES 57 SECONDS EAST, 114.28 FEET TO THE SOUTHWESTERLY RIGHT OF WAY LINE OF N.
