ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:


SECTION 1. Section 8-32-130 ofthe Municipal Code ofthe City of Chicago is hereby amended by adding the language underlined and deleting the language struck through, as follows:
8-32-130 Loading and unloading operations.
No person shall undertake or cause the loading, unloading, opening, closing or other handling of boxes, crates, containers, building materials, garbage cans, recycling cans, dumpsters or similar objects between the hours of 10:00 P.M. and 7:00 A.M. in such a manner as to cause a noise disturbance within a residential district 250 feet of any residential building or hospital, or within a noise sensitive zone as defined by 8-32-060 ofthe municipal code.
This section may be enforced by the departments of finance, streets and sanitation, and police.
Any person who violates this section shall be liable for a penalty of not less than $250.00 nor more than $500.00 for the first violation; not less than $500.00 nor more than $750.00 for the second violation within one calendar year; and not less than $750.00 nor more than $1.000.00 for the third and each subseguent violation within one calendar year. Each day a violation continues shall constitute a separate and distinct offense.


SECTION 2. This ordinance shall be in full force and effect 10 days after passage and publication.
