Ladies and Gentlemen:

At the request of the Commissioner of Planning and Development, I transmit herewith ordinance authorizing an expenditure of Open Space Impact Fee funds for property located at 4546 North Kedvale.

Your favorable consideration of this ordinance will be appreciated.

ORDINANCE

WHEREAS, the City of Chicago (the "City") is a municipal corporation and home rule unit of government under Article VII, Section 6(a) ofthe 1970 Constitution ofthe State of Illinois, and as such may exercise any power and perform any function pertaining to its government and affairs; and

WHEREAS, by ordinance adopted on March 28, 2018, the City Council ofthe City (the "City Council"), approved the use ofthe Open Space Fees, in an amount not to exceed Forty-Eight Thousand Five Hundred Fifty-Two Dollars ($48,552), for the acquisition of the property commonly known as 4546 N. Kedvale Avenue, Chicago, Illinois, as further described in Exhibit A (the "Property") and to convey the Property to the Chicago Park District (the "Park District") to i provide open space and recreational facilities for the benefit of the residents of the Albany Park Community Area; and

WHEREAS, the City Council hereby determines that it is in the best interest of the City to grant the Open Space Fees to the Park District so that the Park District, as opposed to the City, may acquire the Property; now, therefore,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. The above recitals are expressly incorporated in and made a part of this ordinance as though fully set forth herein.

SECTION 2. The City Council hereby finds that the expenditure of the Open Space Fees will directly and materially benefit the residents of those Fee-Paying Developments from which the Open Space Fees were collected and approves the use of...
