RESOLUTION

WHEREAS, Union Pacific Railroad owns various railroad tracks throughout the City of Chicago; and

WHEREAS, Pursuant to the Code, Union Pacific is responsible for maintaining its tracks and the area around its tracks; and

WHEREAS, Union Pacific tracks and the property around them are constantly littered with garbage and debris. Furthermore, fences to protect the public are frequently missing or need repair; and

WHEREAS, Within the 31st ward, areas of the fencing are in desperate need of repair along portions of North Kenton Avenue, from Fullerton Avenue to Belmont Avenue; and

WHEREAS, Despite repeated requests to address these issues, Union Pacific has been non- responsive; and

WHEREAS, The condition of the area around Union Pacific fences and tracks invite illegal dumping, trespassing, and other illegal activities, posing a public health hazard and public nuisance; now, therefore,

BE IT RESOLVED, That we, the City Council of the City of Chicago, gathered here together this 14th day of November, 2018, call on Union Pacific Railroad to appear before the Committee on Health and Environmental Protection to explain its plans to remedy these public hazards.
