RESOLUTION AMENDING RULE 14 OF THE RULES OF ORDER AND PROCEDURE OF THE CITY COUNCIL

 

BE IT RESOLVED, That the Rules of Order and Procedure of the City Council, City of Chicago, for the 2011 - 2015 term, are hereby amended as follows.

RULE 14. Every member who shall be present when a question is stated from the Chair shall vote thereon, unless excused by the Council.

 

Any member seeking to be excused from a vote for reasons of a conflict of interest must file a statement of recusal with the Office of the Citv Clerk that details the nature of the conflict, with whom the conflict exists, and whether the conflict is ongoing or in the past.

 

The statement of recusal must be filed as soon as the Alderman becomes aware of the conflict, or within 48 hours of the introduction of the legislative matter at full City Council, whichever is sooner. If the matter is filed as a Direct Introduction to a committee, the statement of recusal must be filed within 24 hours of introduction, and the conflicted council member may not participate in or be present at the committee hearing.

 

Upon the filing of a statement of recusal, the conflicted council member may not participate in any debate, discussion, or vote - whether in committee hearings, public hearings or a debate before the full citv council - in anv way. If the conflicted member has a leadership role in the committee to which the matter is referred, that member may not be present for the consideration for the matter, and may not preside over the hearing.

 

The Office of the Citv Clerk shall post the statement of recusal on its website within two working days of receiving it. or before the meeting in which the City Council considers the matter, whichever is sooner.
