SUBSTITUTE ORDINANCE

 

 

HE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

 

 

 

SECTION 1. If an emerging business permit to engage in the business of mobile boutique operator has been issued under Section 4-4-022 of the Code, then, notwithstanding any language to the contrary in subsection (d) of Section 4-4-022, such permit shall expire on January 31, 2020, subject to the condition that the permittee shall continue to operate under the conditions of operation signed and notarized by the Department of Business Affairs and Consumer Protection ("BACP" or "Department") when the original emerging business permit was issued.

If, as of March 13, 2019, a permittee holding a valid permit to engage in the business of mobile boutique operator is in compliance with the applicable conditions of operation signed and notarized by BACP, the Department shall: (1) renew such permit without any further action required by the permittee; (2) waive the permit fee that would otherwise apply in the case of renewal; and (3) issue a new permit to the permittee with an expiration date of January 31, 2020.

 

The Department is authorized to issue new emerging business permits to engage in the business of mobile boutique operator. Provided, however, that: (i) any such permit shall terminate on January 31, 2020; and (ii) the permit fee set forth in Section 4-5-010(11) shall not be prorated.

 

 

SECTION 2. This Ordinance shall take full force and effect upon its passage and approval.

Your Committee on License and Consumer Protection, having under consideration a substitute ordinance introduced by Mayor Rahm Emanuel and the Commissioner of Business Affairs and Consumer Protection (which was referred on March 13, 2019), ordinance to amend Section 4-4 of the Municipal Code of Chicago regarding the extension of duration for Emerging Business Permits, begs leave to recommend that Your Honorable Body pass the substitute ordinance which is transmitted herewith.

 

This recommendation was concurred in by a viva voce vote of the members of the committee on April 4, 2019.
