RESOLUTION
WHEREAS, on March 18, 2020, Mayor Lori Lightfoot executed Executive Order 2020-01 which declared a public health emergency caused by the coronavirus pandemic and granted her broad and extraordinary powers during the emergency (the "Executive Order");
WHEREAS, among other powers granted in the Executive Order, the Executive Order authorized the City's Chief Procurement Officer to negotiate and execute contracts for emergency supplies and services up to $1,000,000.00 for each such contract, which contract shall include terms that the Chief Procurement Officer deems necessary or appropriate to effectively address the Emergency;
WHEREAS, among other powers granted in the Executive Order, the Executive Order authorized the City's Budget Director to establish new funding lines, consolidate funding lines, and transfer or otherwise reallocate currently appropriated funds, including making fund transfers between City Departments;
WHEREAS, among other powers granted in the Executive Order, the Executive Order authorized the Commissioner of Assets, Information and Services to enter into temporary agreements for the use and occupancy of real property and to provide indemnification in such agreements;
WHEREAS, it is the purview and legal responsibility of the City Council to approve and authorize appropriations by the City, to pass a balanced budget and to protect the fiscal integrity ofthe City;
WHEREAS, the Executive Order fails to include the oversight or approval of the Chicago City Council in any ofthe aforementioned authorizations and due to such failure, violates the City of Chicago Municipal Code in a myriad of ways;
NOW, THEREFORE, we, the members ofthe Chicago City Council hereby resolve to pass this resolution requiring as follows:
The City's Chief Procurement Officer, the City's Budget Director and the City's Commissioner of Assets, Information and Services shall, within fourteen (14) days of the passage ofthis resolution, appear before the City Council'...
