Dear Mr. Flessner:

 

Pursuant to a request from CDOT Engineer Conan Chan, we are transmitting herewith for your review and approval as to form and legality an opening ordinance and three (3) copies of a proposed opening to vehicular traffic of N. Mies Van Der Rohe Way between E. Pearson Street and E. Chicago Avenue in substantially the form shown in the attached plat which for greater certainty is hereby made a part ofthis ordinance. This property is located in the 2nd Ward.

 

All utilities are either uninvolved or already accommodated. The people to contact in connection with this proposed ordinance arc Engineer Conan Chan, or Engineer John Cecchin at 312-744-2255.

PUBLIC STREET OPENING

 

 

WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and

 

 

WHEREAS, the City can enhance public access by opening new rights of way or widening existing rights of way; and

 

 

WHEREAS the City seeks to widen the west side of N. Mies Van Der Rohe Way between E. Pearson Street and E. Chicago Avenue adjacent to the public area commonly known as Seneca Park, with an approximate address of approximately 800-820 N. Mies Van Der Rohe Way; now, therefore,

 

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

 

 

SECTION 1. The opening of public right of way is described as follows:

 

THAT PART OF SOUTH FRACTIONAL QUARTER OF THE FRACTIONAL SECTION 3, TOWNSHIP 39 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS (ANTE-FIRE).

 

A NORTH-SOUTH 3-FOOT WIDE STRIP OF LAND LYING WEST OF AND ADJOINING THE NORTH-SOUTH 50-FOOT RIGHT OF WAY OF N. MIES VAN DER ROHE WAY AS OPENED BY ORDINANCE PASSED JULY 16, 1930, RECORDED SEPTEMBER 9, 1930 AS CASE NUMBER 523736S, ALSO BEING THE EAST THREE FEET OF THAT PART OF BLOCK 21 AND ACCRETIONS THERETO IN CANAL TRUSTEES' SUBDIVISION, ANTE-FIRE, OF THE SOUTH FRACTIONAL QUARTER OF FRACTIONAL SECTION 3, TOWNSHIP 39 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN, WHICH LIES WEST OF A LINE 581 FEET EAST OF AND PARALLEL WITH THE EAST LINE OF NORTH MICHIGAN AVENUE, (FORMERLY PINE STREET AS SAME WAS ORIGINALLY LAID OUT) IN BLOCK 21 AND ACCRETIONS THERETO OF CANAL TRUSTEES1 SUBDIVISION, ANTE-FIRE, IN FRACTIONAL SECTION 3 TOWNSHIP 39 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS, ABOVE DESCRIBED PARCEL CONTAINING 655 SQUARE FEET OR 0.015 ACRES, MORE OR LESS as shaded and legally described by the words "HEREBY OPENED FOR PUBLIC WAY" on the Plat hereto attached as Exhibit A, which plat for greater certainty, is hereby made a part of this ordinance, be and the same is hereby opened to vehicular traffic as the same is intended for public use and the public interest will be subserved by such opening.

SECTION 2. The Opening to Vehicular Traffic herein provided for is made upon the express condition that within one hundred eighty (180) days after the passage of this ordinance, the Chicago Department of Transportation. Division of Engineering, shall file or cause to be filed for recording in the Office of the Recorder of Deeds of Cook County, Illinois, a certified copy of this ordinance, together with the full-sized corresponding plat as approved by the Department of Transportation's Superintendent of Maps and Plats.

 

SECTION 3. This ordinance shall take effect and be in force from and after its passage and publication. The opening shall take effect upon its recording.
