Dear Mr. Flessner:
Pursuant to a request from Mr. David Pinkerton, we are transmitting herewith for your review and approval as to form and legality an original and three (3) copies of a proposed vacation of a street remnant along the northern periphery of W. Pershing Road between S. Halsted Street and S. Emerald Avenue. This property is located in the 11th Ward.
Lakeside Bank is the successor owner of property, as auctioned and sold by the Department of General Services in 2018. The portion sold however was public way, which has resulted in a cloud upon the title. As such, both the owner and the Department of Transportation wish to officially vacatethe area, in order to clear confusion regarding the status ofthe land. The people to contact in connection with this proposed ordinance are Attorney Paul Kolpak at 847-647-0336, and Mr. David Pinkerton at 312-435-1631.
Section 2 of the ordinance reserves a blanket easement for any utility currently existing within the area to be vacated. Section 3 provides indemnification language. Sections 4 and 5 include standard recording and other language regarding the ordinance.
