SUBSTITUTE ORDINANCE


WHEREAS, it is the established policy ofthe City of Chicago to assure that all persons within its jurisdiction shall have equal access to public services and shall be protected in the enjoyment of civil rights, and to promote mutual understanding and respect among all who live and work within this city; and
WHEREAS, the City of Chicago in multiple ordinances and in departmental policies prohibits the discrimination against or unjust treatment of individuals on the basis of gender identity; and
WHEREAS, many forms of City documentation, in various ways and for various reasons, solicit, require, and/or display a designation of "sex" or "gender"; and
WHEREAS, the accommodation of every individual's preferred gender expression and identity in City documentation is in keeping with the above commitments to equal treatment under law; now, therefore,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. Section1-4-100 of the Municipal Code of Chicago is hereby amended by adding the language underscored, and by deleting the language struck through, as follows:

1-4-100 Interpretation of language.

Whenever the masculine gender is used in this Code, females as woll as malos all genders shall be deemed to be included.

SECTION 2. Chapter 2-160 ofthe Municipal Code of Chicago is hereby amended by adding the language as a new Section 2-160-025, as follows:
2-160-025 Gender identity option in City documentation
No form issued by the City shall ask an individual's sex unless it is necessary for medical reasons or required by another law.
The City may ask for the gender identity of an individual when it is necessary for medical reasons or required by another law.
Where selection of gender identity from predetermined options is required by design of any City form, the gender identity options on said forms shall include "male", "female", and "nonbin...
