Be It Ordained by the City Council of the City of Chicago:
SECTION 1. Permission and authority are hereby given and granted to LAND TRUST 310011, upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, seven (7) Planter(s) on the public right-of-way for beautification purposes adjacent to its premises known as 43 E. Burton PI
Said Planter(s) at E. Burton measure(s):
One (1) at thirty-two point four one (32.41) feet in length, and seven point nine one (7.91) feet in width for a total of two hundred fifty-six point three six (256.36) square feet.
Said Planter(s) at E. Burton measure(s):
One (1) at sixty-three point nine one (63.91) feet in length, and seven point nine one (7 91) feet in width for a total of five hundred five point five three (505.53) square feet.
Said Planter(s) at E. Burton measure(s):
One (1) at fifteen point zero eight (15.08) feet in length, and six point three three (6.33) feet in width for a total of ninety-five point four six (95.46) square feet.
Said Planter(s) at E. Burton measure(s)
One (1) at twenty-eight point four one (28 41) feet in length, and four (4) feet in width for a total of one hundred thirteen point six four (113 64) square feet.
Said Planter(s) at E. Burton measure(s):
One (1) at fifty point five eight (50 58) feet in length, and four (4) feet in width for a total of two hundred two point three two (202.32) square feet.
Said Planter(s) at E. Burton measure(s):
One (1) at twenty-nine point zero eight (29.08) feet in length, and four (4) feet in width for a total of one hundred sixteen point three two (116 32) square feet
Said Planter(s) at N. Astor measure(s):
One (1) at twenty-nine point eight three (29.83) feet in length, and ten point nine one (10.91) feet in width for a total of three hundred twenty-five point four five (325.45) square feet.
Grantee must allow the required clear and unobstructed space for pedestrian passage at all times per rules and regulations approved by the Department of Transportation.
The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk
Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Planning and Development and Department of Transportation (Division of Project Development)
This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago
The grantee shall pay to the City of Chicago as compensation for the privilege #1145149 herein granted the sum of zero (S.00) per annum in advance
A 25% penalty will be added for payments received after due date.

The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.
Authority herein given and granted for a period of five (5) years from and after 12/16/2019.

An ordinance has been prepared by the Department of Business Affairs and Consumer Protection - Small Business Center-Public Way Use Unit for presentation to the City Council.
