SUBSTITUTE ORDINANCE
WHEREAS, the Annual Appropriation Ordinance for the year 2020 ("2020 Appropriation Ordinance") ofthe City of Chicago (the "City") contains estimates of revenues receivable as grants from agencies ofthe state and federal governments and public and private agencies; and
WHEREAS, the City through its Office of the Mayor ("Mayor's Office") has been awarded private grant funds in the amount of $50,000 by PolicyLink which shall be used for the Cities and Counties for Fines and Fees Justice Program; and
WHEREAS, the City through its Mayor's Office has been awarded private grant funds in the amount of $95,000 by the Walder Foundation which shall be used for the Walder Fellowship COVID-19 Program; and
WHEREAS, the City through its Department of Cultural Affairs and Special Events has been awarded federal grant funds in the amount of $250,000 by the National Endowment for the Arts which shall be used for the City Arts Grant CARES Act Program; and
WHEREAS, the City through its Department of Public Health ("Health") has been awarded additional federal grant funds in the amount of $1,834,000 by the United States Department of Health and Human Services ("USDHHS") which shall be used for the Epidemiology and Laboratory Capacity CARES Act Program; and
WHEREAS the City through Health has been awarded additional federal grant funds in the amount of $4,926,000 by USDHHS which shall be used for the Hospital Preparedness Program; and
WHEREAS, the City through Health has been received federal carryover grant funds in the amount of $1,334,000 by USDHHS which shall be used for the Vaccine Preventable Disease (Immunization and Vaccines for Children) Program; and
WHEREAS, the City through its Department of Family and Support Services ("DFSS") has been awarded federal grant funds in the amount of $1,900,000 by USDHHS which shall be used for the Early Head Start CARES Act Program; and
WHEREAS, the City through DFSS has been awarded federal grant funds in the amount of $967,000 by USDHHS which shall be used for the Early Head Start Child Care Partnership CARES Act Program; and
WHEREAS, the City through DFSS has been awarded federal grant funds in the amount of $176,000 by USDHHS which shall be used for the Early Head Start Expansion - CARES Act Program; and
WHEREAS, the City through DFSS has been awarded carryover state grant funds in the amount of $41,000 by the Illinois Department of Human Services which shall be used for the Emergency and Transitional Housing Program; and
WHEREAS, the City through DFSS has been awarded federal grant funds in the amount of $8,151,000 by USDHHS which shall be used for the Head Start CARES Act Program; and
WHEREAS, the City through its Department of Transportation ("CDOT") has been awarded additional federal grant funds in the amount of $20,000,000 by the County of Cook's Department of Transportation and Highways which shall be used for the Cook County Highway Program; and
WHEREAS, the City through CDOT has been awarded state grant funds in the amount of $29,609,000 by the Illinois Department of Transportation which shall be used for the Rebuild Illinois Program; and
WHEREAS, the City through CDOT has been awarded public grant funds in the amount of $1,500,000 by the Metropolitan Water Reclamation District of Greater Chicago ("MWRD") which shall be used for the Shoreline Project; and
WHEREAS, the City through CDOT has been awarded public grant funds in the amount of $197,000 by the MWRD which shall be used for the Stormwater Mitigation Program; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO AS FOLLOWS:
SECTION 1. The amount of $69,655,000 not previously appropriated, representing new grants and $1,375,000 representing carryover grant funds are hereby appropriated into Fund 925 -Grant Funds for the year 2020. The 2020 Annual Appropriation Ordinance is hereby amended by striking the words and figures and adding the words and figures indicated in the attached Exhibit A which is hereby made a part hereof.
SECTION 2. The Budget Director or her designee shall administer and use the Coronavirus Relief Fund and FEMA Public Assistance grant funds only as authorized by the pertinent grant terms ("Eligible Projects") including execution of agreements for Eligible Projects. This ordinance shall be in full force and effect upon its passage and approval, and this Section 2 shall apply retroactively to the earliest date of grant eligibility for expenditures pursuant to such Eligible Projects.
SECTION 3. To the extent that any ordinance, resolution, rule, order or provision of the Municipal Code of Chicago, or part thereof, is in conflict with the provisions of this ordinance, the provisions of this ordinance shall control. If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this ordinance.
SECTION 4. This ordinance shall be in full force and effect upon its passage and approval.
