ORDINANCE
WHEREAS, From time to time street furniture paid for by the City of Chicago is no longer useful to the City or to a Special Service Area and is designated for removal; and
WHEREAS, Such street furniture may nonetheless have useful service left in it, and could be of great use and value to another entity; and
WHEREAS, Special Service Area 27 has in its possession two pieces of street furniture that, while no longer useful in their current location, could be of significant use elsewhere; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. Special Service Area #27 ("SSA 27") is hereby authorized to negotiate and finalize the sale of two items of street furniture described on Exhibit A, free and clear of any liens or encumbrances. SSA 27 shall convey said items of furniture in "as is" condition without any warranties either expressed or implied, and expressly excludes any warranty of merchantability and fitness for a particular purpose. Said sale(s) shall exclude any obligation by the City or SSA 27 to deliver or otherwise transport the furniture, and also excludes any warranties, either expressed or implied, regarding the furniture's suitability for transport.
SECTION 2. An authorized representative of SSA 27 is hereby authorized to enter into and execute such other documents as may be necessary and proper to implement such sale(s).
SECTION 3. It is anticipated that the proceeds from such sale(s) will be appropriated by SSA 27 in its 2021 budget.
SECTION 4. This ordinance shall be in full force and effect from and after its passage and approval.
