ORDINANCE
WHEREAS, In October 2016, the Chicago City Council established the position of the Deputy Inspector General for Public Safety ("Public Safety Deputy"), following the release of a video depicting the murder of Laquan McDonald and at the recommendation of the Police Accountability Task Force; and
WHEREAS, The Public Safety Deputy is empowered to, among other things, conduct reviews and audits of particular policies, procedures, and practices ofthe Chicago Police Department ("CPD"), the Civilian Office of Police Accountability, and the Police Board, and to make findings and recommendations based on those findings to inform and improve future activities; and
WHEREAS, The Public Safety Deputy has released audits and reports on critical issues including, but not limited to, CPD's management of School Resource Officers, the Juvenile Intervention & Support Center, CPD's "gang database," CPD overtime controls, CPD's management and production of records, officer use of body-worn cameras, and CPD's compliance with the Firearm Owners Identification Card Act; and
WHEREAS, The efficacy of the Public Safety Deputy's audits and reports relies, in part, on the ability of the Chicago City Council and other municipal officials to promptly review each audit and report and to meet publicly to discuss the Public Safety Deputy's findings and recommendations; now, therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. Section 2-56-245 ofthe Municipal Code ofthe City of Chicago is hereby amended by inserting the language underscored, and by deleting the language struck through, as follows:
Chapter 2-56-245 Response to Recommendations by the Public Safety Deputy.
If the Public Safety Deputy's report includes recommendations concerning the Police Department, the Police Board, the Office, or another City department or agency, that entity must
submit a written response to such recommendation within <S0 30 days of its receipt of the Public Safety Deputy's report. The response shall include either (1) a description of any corrective or other actions taken or to be taken in response to the recommendation, (2) the basis for rejecting the recommendation in whole or in part, or (3) a request for a 30-day extension for making its response if additional time is needed by the entity to respond to the recommendation. In addition, at the request of at least three aldermen, or the Inspector General, the Chairman of the City Council Committee on Public Safety shall request that an appropriate representative of the Office of Inspector General and the head of the department or agency in question, or their designee, appear at a hearing of the Committee on Public Safety to explain and respond to questions concerning such response. The hearing shall occur within 45 days of the request to appear.
