SUBSTITUTE ORDINANCE

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. If an emerging business permit to engage in the business activity of providing short-distance ecofriendly scheduled shuttles using 3-wheeled electric vehicles has been issued under Section 4-4-022 of the Municipal Code of Chicago ("Code"), then, notwithstanding any language to the contrary in subsection (d) of Section 4-4-022 ofthe Code, such permit shall expire on August 15, 2022, subject to the condition that the permittee shall continue to operate under the conditions of operation signed and notarized by the Department of Business Affairs and Consumer Protection ("BACP" or "Department") when the original emerging business permit was issued.

If, as of August 10, 2018, a permittee holding a valid permit to engage in the business activity of providing short-distance ecofriendly scheduled shuttles using 3-wheeled electric vehicles is in compliance with the applicable conditions of operation signed and notarized by BACP, the Department shall: (1) extend the expiration of such permit without any further action required by the permittee; (2) waive the permit fee that would otherwise apply in the case of renewal; and (3) issue a new permit to the permittee with an expiration date of August 15, 2022.

The Department is authorized to issue new emerging business permits to engage in the business activity of providing short-distance ecofriendly scheduled shuttles using 3-wheeled electric vehicles. Provided, however, that: (i) any such permit shall terminate on August 15, 2022; and (ii)the permit fee set forth in Section 4-5-010(11) shall not be prorated.

Nothing provided in this ordinance shall be construed to prohibit the Commissioner from amending the conditions of operation attached to any emerging business permit issued for engaging in the business activity of providing short-distance ecofriendly scheduled shuttles using 3-wheeled electric vehicles.

SECTION 2. This Ordinance shall take effect upon its passage and approval.
