COMMERCIAL VACATION ORDINANCE
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) ofthe 1970 Constitution ofthe State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the properties at 1601-1617 W. Walnut Street, 212-222 N. Ashland Avenue, 200-208 N. Ashland Avenue, and 1600-1624 W. Lake Street Avenue are owned by Ashland Lake LLC ("Developer"); and
WHEREAS, the properties at 1621 -1627 W. Walnut Street and 1626-1628 W. Lake Street are owned by Walnut Paulina LLC, which has quit claimed any and all of its interests in the public alleys herein vacated, to the Developer; and
WHEREAS, the Developer proposes to use the portion ofthe alleys to be vacated herein for a driveway to serve its adjacent buildings; and
WHEREAS, the City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of that portion of the public alleys, described in the following ordinance; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1.
VACATION OF:
THAT PART OF THE EAST-WEST 16 FOOT WIDE PUBLIC ALLEY LYING SOUTH OF AND ADJOINING THE SOUTH LINE OF LOTS 4,3, AND THAT PART OF LOT 2; LYING WEST OF AND ADJOINING THE SOUTHERN EXTENSION OF THE EAST LINE OF SAID LOT 4 TO THE NORTHEAST CORNER OF SAID LOT 8 AND LYING EAST OF AND ADJOINING THE EASTERLY TERMINUS OF PREVIOUSLY VACATED SAID ALLEY AS VACATED BY ORDINANCE RECORDED JANUARY 3, 1980 (79-579) AS DOCUMENT NUMBER 93-422169, ALL INCLUSIVE IN LILLJA'S SUBDIVISION OF PART OF BLOCK 48 OF CANAL TRUSTEE'S SUBDIVISION, ANTE-FIRE OF SECTION 7, TOWNSHIP 39 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS;
