BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO THAT THE FOLLOWING PORTIONS OF PUBLIC WAY BE CLOSED TO PUBLIC TRAFFIC:

 

 

 

SECTION 1.

OHIO STREET RIGHT-OF-WAY, THE CENTER LINE OF WHICH BEING ALSO THE NORTH LINE OF BLOCK 10 IN WRIGHT AND WEBSTER'S SUBDIVISION, ANTE-FIRE, ALL IN THE NORTHEAST QUARTER OF SECTION 12, TOWNSHIP 39 NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL MERIDIAN, BOUNDED AND DESCRIBED AS FOLLOWS: LYING SOUTH OF AND ADJOINING THE NORTH LINE OF SAID W. ILLINOIS, (SAID ABOVE DESCRIBED PARCEL CONTAINING 31,769 SQUARE FEET OR 0.7293 ACRES, MORE OR LESS, WITH THE TOTAL AREA IN SAID ABOVE PARCELS CONTAINING 39,225 SQUARE FEET OR 0.9005 ACRES, MORE OR LESS), as shaded and legally described by the words "HEREBY CLOSED TO PUBLIC TRAFFIC" on the plat hereto attached as Exhibit A, which plat, for greater certainty, is hereby made a part of this ordinance, be and the same is hereby closed to all traffic except for that associated with the property holders directly adjacent to the portions of the streets hereby closed, or by Fire, Police and other emergency vehicles, and the public interest will be subserved by such closings.

 

SECTION 2. The closures herein contemplated are made with the express condition that all telecommunication utilities as currently situated within the limits of the public ways herein closed, shall have unimpeded ingress and egress for the repair and maintenance of their facilities, and that no permanent structures shall be placed over or interfere with said facilities, or current soil grades changed by the Public Building Commission or the Department of Streets and Sanitation or its successors, without the express written pre-review and approval of the involved respective utilities.

 

SECTION 3. The closure herein provided for is made upon the express condition that all improvements made to the portions of right of way herein closed to public traffic shall be fully permitted, impermanent, removable, and that the street be returned to original condition by the Public Building Commission in accordance with the most current version of the Chicago Department of Transportation's Regulations for Opening. Repair and Construction in the Public Way and its appendices, in the event that the streets are reopened to public traffic. The sale of the City owned parcels adjacent to the areas herein closed shall immediately invalidate the Closure and reopen the street, or require vacation of the street with appraised compensation due to the City.
