Be It Ordained by the City Council ofthe City of Chicago:

SECTION 1. Permission and authority are hereby given and granted to M & R DEVELOPMENT, LLC, upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, twenty-nine (29) Caisson(s) under the public right-of-way adjacent to its premises known as 1025 W. Addison St

Said Caisson(s) at W. Addison Street measure(s):

Eleven (11) at six point four two (6.42) feet in length, and one point five eight (1.58) foot in width for a total of one hundred eleven point five eight (111.58) square feet.

One (1) at two point two five (2.25) feet in length, and one point five eight (1.58) foot in width for a total of three point five six (3.56) square feet.

Said Caisson(s) at N. Sheffield Avenue measure(s):

One (1) at five point seven five (5.75) feet in length, and one point eight three (1.83) foot in width for a total of ten point five two (10.52) square feet.

One (1) at six point five (6.5) feet in length, and one point six seven (1.67) foot in width for a total of ten point eight six (10.86) square feet.

One (1) at six point two five (6.25) feet in length, and one point five (1.5) foot in width for a total of nine point three eight (9.38) square feet.

One (1) at six (6) feet in length, and one point three three (1.33) foot in width for a total of seven point nine eight (7.98) square feet.

One (1) at five point seven five (5.75) feet in length, and one point two five (1.25) foot in width for a total of seven point one nine (7.19) square feet.

One (1) at five point three three (5.33) feet in length, and one point zero eight (1.08) foot in width for a total of five point seven six (5.76) square feet.

One (1) at four point five eight (4.58) feet in length, and point nine two (.92) feet in width for a total of four point two one (4.21) square feet.

One (1) at seven (7) feet in length, and two point zero eight (2.08) feet in width for a total of fourteen point five six (14.56) square feet.

One (1) at six point six six (6.66) feet in length, and two point zero eight (2.08) feet in width for a total of thirteen point eight five (13.85) square feet.

Two (2) at ten point three three (10.33) feet in length, and three point five eight (3.58) feet in width for a total of seventy-three point nine six (73.96) square feet.

One (1) at seven point five eight (7.58) feet in length, and two point seven five (2.75) feet in width for a total of twenty point eight five (20.85) square feet.

One (1) at seven point five (7.5) feet in length, and two point five eight (2.58) feet in width for a total of nineteen point three five (19.35) square feet.

One (1) at seven point two five (7.25) feet in length, and two point three three (2.33) feet in width for a total of sixteen point eight nine (16.89) square feet.

One (1) at six (6) feet in length, and one point four one (1.41) foot in width for a total of eight point four six (8.46) square feet.

One (1) at five point six six (5.66) feet in length, and one point one six (1.16) foot in width for a total of six point five seven (6.57) square feet.

One (1) at two point eight three (2.83) feet in length, and one (1) foot in width for a total of two point eight three (2.83) square feet.

The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and

Consumer Protection and the Office of the City Clerk.

Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Planning and Development and Department of Transportation (Office of Underground Coordination).

This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.

The grantee shall pay to the City of Chicago as compensation for the privilege #1147995 herein granted the sum of four hundred ($400.00) per annum in advance.

A 25% penalty will be added for payments received after due date.

The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.

Re: An ordinance to use and maintain a portion of the public right-of-way for twenty-nine (29) caisson(s) for M & R DEVELOPMENT, LLC, adjacent to the premises known as 1025 W. Addison St

Dear Alderman Thomas Tunney:

The applicant referenced above has requested the use of the public right-of-way for a caisson(s). An ordinance has been prepared by the Department of Business Affairs and Consumer Protection - Small Business Center -Public Way Use Unit for presentation to the City Council. Because this request was made for properties located in your ward, as approved by you as per the attached, I respectfully request that you introduce the attached ordinance at the next City Council meeting.
