DEDICATION FOR PUBLIC WAY ORDINANCE
Be itOfdained by the City Council of the City of Chicago!:

SECTION T. The Commissioner of the Department of Transportation, or any of her designees, is each hereby authorized and directed to approve a dedication of certain property owned.by Northwestern Memorial Healthcare, an Illinois not-for-profit corporation,("Develdper") for Use as public way, in the block bounded by W. Irving Park Road, W. Byron Street-, N. Kilpourn Avenue and N. Kenneth Avenue, and legally described below and in the attached plat (Exhibit A, CDOT File:22-45-21-3961) which, for greater certainty, is hereby made a part of this ordinance.

SECTION 2.
The dedication is legally described as follows':!'
the north 16 feet of the south 27 feet of lot 4 in tremain's addition to irving park, being a subdivision of the northeast 10 acres of the northwest quarter of section 22, township 40 north, range 13 east of the third principal meridian, according to the plat thereof recorded june 26th 1873 as document number 110573, in cook county, illinois, said parcel of land herein described containing 0.048 acre (2,109 square feet), more or Less.


SECTION 3. the Developer acknowledges that any water mains and private sewers, appurtenances and connections within the area to be,dedicated shall be sealed, removed or relocated to private property at the Developer's expense, in accordance with the standard procedures of the Department of Water Management ("DWM"), or established as public sewers through separate City Council action, and only after the DWM's receipt and acceptance of videotape inspection and as-built drawings. In the event that any existing private sewer is abandoned, the abandonment plans must be reviewed, approved and permitted by the DWM's Sewer Design Section-prior to work;


SECTION 4. The Developer also, acknowledges that it is responsible fpr proyiding proper drainage including the public sewer main and associated structures in the alley herein dedicated, at its sole expense and in accordance with plans reviewed, approved and permitted by the DWM Sewer Design Section; prior to work. As-built plans of the public alley sewer and combined, public main sewers indicating the location of mains and1 appurtenances must be submitted to the DWM's Sewer Section within thirty (30) days of completion. AM work on both private and public land must be dope by a licensed drainlayer.

SECTION 5 The public way dedication herein provided for is made upon the express condition that within 180 days afterthe passage x>f this ordinance and its related documents, and prior to recording, the Developer shall make a'security deposit to the City.Treasury-of the Cityjof Chicagp. for a'quoted.sum sufficient.to.defray the cost of work for public paying, curb, arid related appurtenances associated with its project, for juse in the event that it defaults in its obligationi to construct the directed improvements in accordance with the most current version ofthe Department of Transportation's Regulations for Opening. Repair and Construction in the Public Way and its appendices, and in accordance with the executed Duty to Build Agreement attached hereto and made a; part of this ^ordinance as EXHIBIT B. The Division of Infrastructure Management, Construction Compliance Unit, Room 905 City Hail,.shall return the deposit monies (minus service fee) upon: inspection ofthe work and approval:



SECTION 6. The dedication herein provided for is made upon the express condition that within one hundred eighty (180) days afterthe passage.of this ordinance, the Developer shall' file or cause to be filed for recordation with" the Office.of the Recorder of Deeds of Cook County, Illinois a certified copy of this ordinance, together .with the attached Plat of Dedication approved by the Department of Transportation's Superintendent of Maps and Plats.


SECTION 7. This ordinance shall take effect and be in force from and after its passage and publication. The dedication shall take effect and be in force from and afterthe recording of this ordinance and associated plat.

DUTY TO BUILD AGREEMENT FOR CREATION OF NEW STREET/ALLEY

In support of Northwestern Memorial Healthcare's (NMHC) current application with the Chicago Department of Transportation's Public Way unit, for a dedication of its private property for a new public way (public alley), I hereby state that I have the authority to agree to and bind NMHC to the below terms ofthe dedication.

NMHC is aware that it is responsible for the construction of all public and private rights
of way (streets, alleys, etc) described on the Plat of Subdivision/Dedication associated
with unique CDOT FILE: 2^-r^;S~-^:l t-.,3.^ \ (to be provided).

NMHC further understands that all rights of way (both public and private) must be built to standard City specifications as detailed in the most current version CDOTs Regulation for Openings, Construction and Repair in the Public Way.

Lastly, NMHC understands that construction deposits will be required to assure that the work is done correctly. An inspection will be conducted by the City upon completion of the work. The City of Chicago reserves the right to require demolition and reinstallation of any facilities that are judged to be sub par or that do not adhere to the City's standa nds.
