RESIDENTIAL-BUSINESS PLANNED DEVELOPMENT NO. PLANNED DEVELOPMENT STATEMENTS
The area delineated herein as Planned Development Number _, ("Planned Development") consists
ol'approximately 63,168 square feet of property which is depicted on the attached Planned Development Boundary and Properly Line Map (the "Properly"). Jamal Properties (601 \V. Monroe) Inc. is the owner the Property and the "Applicant" for this Planned Development.
The requirements, obligations and conditions contained within this Planned Development shall be binding upon the Applicant, its successors and assigns and, if different than the Applicani, the legal title holders and any ground lessors. All rights granted hereunder to the Applicant shall inure to the benefit of the Applicant's successors and assigns and, if different than the Applicant, the legal title holder and any ground lessors. Furthermore, pursuant to the requirements of Section 17-8-0400 ofthe Chicago Zoning Ordinance (the "Zoning Ordinance"), the Property, at the time of application for amendments, modifications or changes (administrative, legislative or otherwise) to this Planned Development, shall be under single ownership or designated control. Single designated control is defined in Section 17-8-0400 ofthe Zoning Ordinance.
All applicable official reviews, approvals or permits are required to be obtained by the Applicant or its successors, assignees or grantees. Any dedication or vacation of streets or alleys or grants of easements or any adjustment ofthe right-of-way shall require a separate submittal lo the Chicago Department of Transportation ("CDOT") on behalf of the Applicant or its successors, assigns or grantees.
Any requests for grants of privilege, or any items encroaching on the public way, shall be in compliance with the Plans (defined below).
Ingress or egress shall be pursuant lo the Plans and may be subject to the review and approval of the Department of Planning and Development ("DPD") and CDOT. Closure of all or any public streel or alley during demolition or construction shall be subject to the review and approval ofCDOT.
All work proposed in the public way must be designed and constructed in accordance with CDOT Standards for Work in the Public Way and in compliance with the Municipal Code of the City of Chicago. Prior lo the issuance of any Part II approval, the submitted plans must be approved by CDOT.

For purposes of height measurement, the definitions in the Zoning Ordinance shall apply. The height of any building shall also be subject lo height limitations, if any, established by ihe Federal Aviation Administration.
The maximum permitted Floor Area Ratio (''FAR") for the Properly shall be in accordance with the attached Bulk Regulations and Data Table. For the purposes of FAR calculations and measurements, the definitions in the Zoning Ordinance shall apply. The permitted overall FAR identified in the Bulk Regulations Table has been determined using a Net Site Area of 63.168 square feel.
The Applicant acknowledges that the project has received a bonus FAR of 3.74, pursuant to Sec. 17-4-1000 ofthe. Zoning Ordinance. With this bonus FAR, the total FAR lor Ihe Planned Development is 15.75. In exchange for the bonus FAR, the Applicani is required lo make a corresponding payment, pursuant lo Sections 17.4-1003-B & C, prior to the issuance ofthe first building permit for any building in the Planned Development; provided, however, if the Planned Development is constructed in phases, the bonus payment may be paid on a pro rata basis as the lirsl building permit for each subsequent re­building or phase of construction is issued. The bonus payment will be recalculated at the time of payment (including partial payments for phased developments) and may be adjusted based on changes in median land values in accordance with Section 17-4-1003-C.3
The bonus payment will be split between three separate funds, as follows: 80% to the Neighborhoods Opportunity Fund, 10% lo the Citywide Adopt-a-Landmark Fund and 10% to the Local Impact Fund. In lieu of paying the Cily directly, the Department may: (a) direct developers to deposit a portion of the funds with a sister agency to finance specific local improvement projects; (b) direct developers lo deposit a portion ofthe funds with a landmark property owner to finance specific landmark restoration projects; or, (c) approve proposals for in-kind improvements lo satisfy the Local Impact portion ofthe payment.
Upon review and determination, "Part II Review", pursuant lo Section 17-13-0610 of the Zoning Ordinance, a Part II Review Fee shall be assessed by DPD. The fee, as determined by staff at the time, i.s final and binding on the Applicant and must be paid to the Department of Revenue prior to the issuance of any Part II approval.
The Site and Landscape Plans shall be in substantial conformance with the Landscape Ordinance and any other corresponding regulations and guidelines. Final landscape plan review and approval will be by DPD. Any interim reviews associated with site plan review or Part II reviews, are conditional until final Part 11 approval.
The Applicant shall comply wilh Rules and Regulations for the Maintenance of Stockpiles promulgated by the Commissioners ofthe Departments of Streets and Sanitation, Fleet and Facility Management and Buildings, under Section 13-32-085 ofthe Municipal Code, or any other provision of lhat Code.
The terms and conditions of development under this Planned Development ordinance may be modified administratively, pursuant to section 17-13-0611-A of the Zoning Ordinance by the Zoning Administrator upon the application for such a modification by the Applicant, its successors and assigns and, if different than the Applicant, the legal title holders and any ground lessors.

The Applicant acknowledges that il is m the public inleresl lo design, construct and maintain the project in a manner which promotes, enables and maximizes universal access throughout the Property. Plans for all buildings and improvements on the Property shall be reviewed and approved by the Mayor's Office for People with Disabilities to ensure compliance with all applicable laws and regulations related lo access for persons with disabilities and lo promote the highest standard of accessibility.
The Applicant acknowledges that it is in the public inleresl to design, construct, renovate and maintain all buildings in a manner that provides healthier indoor environments, reduces operating costs and conserves energy and natural resources. The Applicani shall obtain the number of points necessary to meet the requirements ofthe Chicago Sustainable Development Policy, in effect at the lime the Part II review process is initiated for each improvement that is subject to the aforementioned Policy and must provide documentation verifying compliance.
The Applicant acknowledges that it is the policy ofthe Cily to maximize opportunities for Minority and Women-owned Business Enterprises ("M/WBEs") and city residents to compete for contracts and jobs on construction projects approved through the planned development process. To assist ihe city in promoting and tracking such M/WBE and city resident participation, an applicant for planned development approval shall provide information at three points in the city approval process. First, the applicant must submit to DPD, as part of its application for planned development approval, an M/WBE Participation Proposal. The M/WBE Participation Proposal musl identify the applicant's goals for participation of certified M/WBE firms in (he design, engineering and construction ofthe project, and of city residents in the construction work. The city encourages goals of (i) 26% MBE and 6% WBE participation (measured against the total construction budget for the project or any phase thereof), and (ii) 50% city resident hiring (measured against the total construction work hours for the project or any phase thereof). The M/WBE Participation Proposal must include a description of the Applicant's proposed outreach plan designed to inform M/WBEs and cily residents of job and contracting opportunities. Second, al Ihe time ofthe Applicant's submission for Part 11 permit review for the project or any phase thereof, the Applicant must submit to DPD (a) updates (if any) lo the Applicant's preliminary outreach plan, (b) a description of the Applicant's outreach efforts and evidence of such outreach, including, without limitation, copies of certified letters to M/WBE contractor associations and the ward office ofthe alderman in which the project is located and receipts thereof; (c) responses to the Applicant's outreach efforts, and (d) updates (if any) to the applicant's M/WBE and cily resident participation goals. Third, prior to issuance ofa Certificate of Occupancy for the projeel or any phase thereof, the Applicant must provide DPD with the actual level of M/WBE and cily resident participation in the project or any phase thereof, and evidence of such participation. In addition lo the forgoing, DPD may request such additional information as the department determines may be necessary or useful in evaluating the extent to which M/WBEs and city residents are informed of and utilized in planned development projects. All such infonnation will be provided in a form acceptable to the Zoning Administrator. DPD will report the data it collects regarding projected and actual employment of M/WBEs and city residents in planned development projects twice yearly to the Chicago Plan Commission and annually to the Chicago City Council and the Mayor.
The Applicant acknowledges and agrees that the rezoning ofthe Property from DC-12 Downtown Core District lo this Planned Development, triggers the requirements of Section 2-44-080 of the Municipal Code (the "Affordable Requirements Ordinance" or "ARO"). Any developer ofa "residential housing project" within the meaning ofthe ARO must: (i) set aside 10% ofthe housing units in the residential

housing project (ARO Units) as affordable units, or wilh the approval of the commissioner of the Department of Housing ("DON") (subject to the transition provisions of Section 2-44-040(0). in consultation with the commissioner of the Department of Planning and Development ('"DPD") as appropriate; (ii) pay a fee in lieu ofthe development ofthe ARO Units (Cash Payment); or (iii) any combination ol" (i) and (ii); provided, however, that residential housing projects with 20 or more units musl provide at least 25% oflhe ARO Units on-site or off-site (Required Units). If the developer elects to provide ARO Units off-site, the oil-site ARO Units must be located within a two-mile radius from the residential housing project and in the same or a different higher income area or downtown district. The Property is located in a downtown district within the meaning ofthe ARO, and the project has a total of 1,053 units. As a result, the Applicant's affordable housing obligation is 105 ARO units (10% of 1,053 rounded down), 26 of which are Required Units (25% of 105. rounded down). Applicani has agreed to satisfy its affordable housing obligation by (a) providing the 26 Required Units on-site in the proposed residential development and (b) making a cash payment to the Affordable Mousing Opportunity Fund in the amount of S 187,939 per unit, S 14,847,181 in total, as adjusted in accordance with Section 2-44-080 ("Cash Payment") in lieu of the development of the remaining 79 ARO units, as set forth in the Affordable Mousing Profile Form attached hereto as an Exhibit. The Applicant agrees lhat the ARO Units must be affordable to households earning no more than 60% ofthe Chicago Primary Metropolitan Statistical Area Median Income (AMI), as updated annually by the City of Chicago. If the Applicant subsequently reduces (or increases) the number of housing unils in the Planned Development, or elects to build a for-sale project instead, the Applicant shall update and resubmit the Affordable Housing Profile Form to the Department of Mousing for review and approval, and the Department may adjust the requirements and number of required ARO Units without amending the Planned Development. Prior to the issuance of any building permits for any residential building in the Planned Development, including, without limitation, excavation or foundation permits, the Applicant must make the required Cash Payment and execute and record an affordable housing agreement in accordance with Section 2-44-080(L). The cash payment will be recalculated at the time of payment (including partial payments for phased developments) and may be adjusted based on changes in the consumer price index in accordance with Section 2-44-080. The terms ofthe affordable housing agreement and any amendments thereto are incorporated herein by this reference. The Applicant acknowledges and agrees that the affordable housing agreement will be recorded against the Planned Development, or the applicable portion thereof, and will constitute a lien against such property. The Commissioner of DOH may enforce remedies for any breach of this Statement 17, including any breach of any affordable housing agreement, and enter into settlement agreements with respect to any such breach, subject to the approval ol'the Corporation Counsel, without amending the Planned Development.
17. Prior to the Part II Approval (Section 17-13-0610 of the Chicago Zoning Ordinance) for the "School" and "Daycare Use", the Applicant shall submit a site plan and floor plans for review and approval by the Department of Planning and Development (DPD). Review and approval by DPD is intended to assure that specific development components substantially conform with the Planned Development (PD) and to assist the City in monitoring ongoing development. Site Plan Approval Submittals (Section 17-13-0800) need only include that portion ofthe Property for which approval is being sought by the Applicant. If the Applicant is seeking approval for a portion oflhe Property that represents less than an entire Sub-Area, the Applicani shall also include a site plan for lhat area ofthe Property which is bounded on all sides by cither public Rights-of-Way or the boundary of the nearest Sub-Area. The site plan provided shall include all dimensioned and planned street Rights-of-Way.

No Part II Approval for the School Use or Ihe Daycare Use shall be granted until Site Plan approval has been granted. Following approval by DPD, Ihe approved Site Plan Approval Submittals, supporting data and materials shall be made part ol'the main file and shall be deemed lo be an integral part ol'the PD.
Alter approval of the Site Plan, changes or modifications may be made pursuant lo the provisions of Statement 12. In the event of any inconsistency between approved plans and ihe terms ol'the PD, the terms of the PD shall govern. Any Site Plan Approval Submittals shall, al a minimum, provide the following information:

an updated traffic study;
Off-street parking requirement determination information pursuant lo Section 17-10-0207-11 of the Chicago Zoning Ordinance including description of the property; maximum number of employees on any one shift; description of clients; the age break-down and number of infants, toddlers, two-year olds, three to four-year olds, pre-sehool & school aged for the day-care use; other uses in the building; anticipated number of clienls; seating capacity; days and hours of operation; proximity to public transportation; number of" any existing off-street parking spaces on-site; proposed pick-up and drop-off plans; and,
approvals from CDOT, MOPD, and Fire.
Sub Area Site Plan Approval Submittals shall include all other information necessary to illustrate substantial conformance to the PD.
The Applicant, its successors and assigns and, if different than the Applicani, the legal title holders to and any ground lessors of the Property, shall provide a dog park as indicated on the Plans. The dog park shall be privately owned, maintained, open to the public (subject to occasional closure for private use), and free of charge, during normal park hours from 6:00am to 11:00pm every day of the year. The public shall have use of" the dog run but Applicant shall be responsible for the costs and performance of maintenance thereof
This Planned Development shall be governed by Section 17-13-0612 ofthe Zoning Ordinance. Should this Planned Development ordinance lapse, the Zoning Administrator shall initiate a Zoning Map Amendment to rezone the property lo the DC-12 Downtown Core Distnct.

On August 26, 2021, the Chicago Plan Commission recommended approval ofthe proposed Residential-Business Planned Development, submitted by Jamal Properties (601 W. Monroe) Inc. The applicant is proposing to rezone the site from DC-12 (Downtown Core District) to a Residential-Business Planned Development to construct a mixed-use, two-phased development, consisting of two towers containing a total of 1,053 residential units, 430 accessory vehicular parking spaces, and ground floor commercial space. The first phase (Subarea A) is proposed to include a 535'-tall tower with 537 residential units, 400 accessory vehicular parking spaces, and ground floor commercial space. The second phase (Subarea B) is proposed to include a 465'-tall tower wilh 516 residential units, 30 accessory vehicular parking spaces, and ground floor commercial space. A 3.74 FAR bonus will be taken and the overall FAR of the planned development will be 15.74. A copy of the proposed ordinance, planned development statements, bulk table and exhibits are attached. 1 would very much appreciate your assistance in having this introduced at the next possible City Council Committee on Zoning.
