ORDINANCE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. Section 17-2-0300 of Title 17 ofthe Municipal Code of Chicago, the Chicago Zoning Ordinance, is hereby amended by by deleting the struck-through language and inserting the underscored language, as follows:
17-3-0300 General District Standards
(Omitted text is unaffected by this ordinance) 17-3-0304 Indoor/Outdoor Operations
17-3-0304-A Bl, B2, B3, and Cl Districts. Except as otherwise provided in this Code, allowed business, service and commercial activities in the Bl, B2, B3, and Cl districts must be conducted within completely enclosed buildings. In addition to the other exceptions provided in this Code, this requirement does not apply to olf-strcet parking or loading areas, automated teller machines, outdoor seating arca3 or drive-through facilities that arc allowed in 3uch districts as a special use.-produce merchants as defined in Section 4-8-010 of this Code, and mobile food vehicles operating on private property as provided in aection 7-38-115(It), the following:
off-street parking or loading areas:
automated teller machines:
outdoor seating areas:
drive-through facilities that are allowed in such districts as a special use:
produce merchants as defined in Section 4-8-010 of this Code:
mobile food vehicles operating on private property as provided in Section 7-38-115flO: and
walk-up accessory transaction windows serving eating and drinking establishments or restaurants (limited and general) as provided in Section 17-9-0131

SECTION 2. Section 17-9-0100 of Title 17 ofthe Municipal Code of Chicago, the Chicago Zoning Ordinance, is hereby amended by inserting the underscored language, as follows:

17-9-0131 Outdoor Walk-up Service Window. Eating and drinking establishments with an outdoor walk-up service window must provide sufficient queuing area at a minimum of 6 square feet per customer in advance of the window to accommodate a minimum of 8 persons, either (T) on the same zoning lot as the use served or (ii") on the adjoining public right-of-wav. subject to public way encroachment approval by the Department of Transportation and, if the establishment is proposing any permanent structure to govern customer queueing on the public right-of-way. approval by the Department of Business Affairs and Consumer Protection.
