COMMERCIAL VACATION ORDINANCE
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 Constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the properties at 1655-1699 N. Throop Street and 1656-1698 N. Throop Street are owned by 1685 N. Throop, LLC, a Delaware limited liability company ("Developer"); and
WHEREAS, the Developer proposes to use the portion ofthe street herein vacated for inclusion in a mixed-use development associated with Planned Development 1438, as approved by the City Council ofthe City ("City Council") on March 13, 2019 ("Planned Development 1438"); and
WHEREAS, the City Council, after due investigation and consideration, has determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of that portion of the public street, described in the following ordinance; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1.
VACATION OF: THAT PART OF N. THROOP STREET 66 FOOT WIDE RIGHT OF WAY LYING EASTERLY AND ADJOINING THE EASTERLY LINE OF LOTS 1,44,45,48,49 AND 56 IN SUB-BLOCK 3 OF BLOCK 18 IN THE SUBDIVISION, ANTE FIRE, OF BLOCKS 17, 18, 20, 21 {EXCEPT LOTS 1,5, AND 12 IN SAID BLOCK 21) AND BLOCKS 23, 28, 29,30,31,32 (EXCEPT LOTS 1, 2, 3, 6 AND 7) AND BLOCKS 33, 38, 39, 40 AND 41 OF SHEFFIELD'S ADDITION TO CHICAGO IN SECTIONS 29,31, 32 AND 33, TOWNSHIP 40 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED OCTOBER 13, 1853, ANTE-FIRE; LYING EASTERLY OF THE EASTERLY LINE OF THE EASTERLY-WESTERLY 16 FOOT WIDE PUBLIC ALLEY HERETOFORE VACATED BY ORDINANCE PASSED NOVEMBER 8, 2017 RECORDED DECEMBER 20, 2017 AS DOCUMENT NO. 1735419053; LYING EASTERLY OF THE EASTERLY LINE OF THE EASTERLY-WESTERLY 16 FOOT WIDE PUBLIC ALLEY HERETOFORE VACA...
