RESOLUTION: Calling on the State Legislature to Expand Remote Participation for
Committee Meetings

WHEREAS, the COVID-19 crisis has demonstrated the need for remote, flexible meeting and conferencing tools in all our lives; and

WHEREAS, the business of government should not be halted by disaster, distance, or other obstacles; and

WHEREAS, temporary arrangements made during the COVID-19 pandemic proved the efficacy and functionality of legislative sessions held via remote conferencing technology; and

WHEREAS, digital meetings make government more observable, available, and accessible to the general public; and

WHEREAS, the ability to participate remotely in committee sessions has allowed elected officials in the City of Chicago to spend less time in transit and more in their districts, serving their constituents; and

WHEREAS, remote public comment proved popular and accessible to members of the public who would not ordinarily have been able to visit their legislative body and offer comment in person; and

WHEREAS, an increase in openness and accessibility is in keeping with the spirit and effect of the Open Meetings Act of the State of Illinois; now therefore:

BE IT RESOLVED, that we, the City Council of the City of Chicago, do hereby call upon and urge the State Legislature of the State of Illinois to amend the Open Meetings Act, 5 ILCS 120, to allow for remote and hybrid meetings of legislative committees, and for remote public comment at such; and

BE IT FURTHER RESOLVED, that we urge the State Legislature and other legislative bodies in Illinois, in the event of such a change, to adopt permanent rules allowing for remote participation and comment at meetings of legislative committees subject to the Open Meetings Act.

SUBSTITUTE ORDINANCE

WHEREAS, Chapter 4-17 of Municipal Code of Chicago authorizes the establishment of Restricted Residential Zones pursuant to an opt-out process, which requires a petition to trigger an ordinance; and

WHEREAS, The requisite procedural requirements have been met; now, therefore,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. Pursuant of Section 4-17-040 ofthe Municipal Code of Chicago ("Code"), the 6th Precinct of the 23rd Ward, as described herein, is hereby designated as a Restricted Residential Zone within the meaning of Chapter 4-17 of the Code. All new or additional shared housing units and vacation rentals shall be prohibited within the boundaries of such 6th Precinct, with such boundaries beginning at the intersection of S. Kolin Av. and S. Archer Av., thence east on S. Archer Av. to S. Kildare Av., thence south on S. Kildare Av. to W. 51st St., thence east on W. 51st St. to S. Tripp Av., thence south on S. Tripp Av. to W. 55th St., thence west on W. 55th St. to S. Kenneth Av., thence north on S. Kenneth Av. to the alley south of the Chicago Belt R.R., thence west on the alley south of the Chicago Belt R.R. to the alley west of S. Kenneth Av., thence north on the alley west of S. Kenneth Av. to C.T.A. frontage access road, thence west on C.T.A. frontage access road to the Chicago Belt R.R., thence east on the Chicago Belt R.R. to W. 53rd St., thence east on W. 53rd St. to S. Kolin Av., and north on S. Kolin Av. to the place of beginning. (See attached document)

NOTICE OF PETITION ACCEPTANCE
Dear Alderwoman Tabares:

This letter serves as notice that the Petition to create a Restricted Residential Zone in Ward 23, Precinct 6 has been accepted by the Office of the City Clerk, pursuant to Section 4-17-030 of the Chicago Municipal Code. This Petition to restrict all new or additional shared housing units and vacation rentals contains the signatures of at least 25% of the registered voters of Ward 23, Precinct 6 as required by Section 4-17-020 of the Chicago Municipal Code.

Enclosed are (1) the original submitted Petition, (2) a Certificate of Acceptance, and (3) a template of an ordinance to create the Restricted Residential Zone that prohibits all new or additional shared housing units and vacation rentals in Ward 23, Precinct 6. There were no comments submitted for this Petition.

CERTIFICATE OF ACCEPTANCE


On January 22, 2021, a Petition to restrict all new or additional shared housing units and vacation rentals in Ward 23, Precinct 6 was submitted to the Office of the City Clerk. On February 23, 2021, the 30-day comment period for the Petition ended. The Office of the City Clerk has reviewed the Petition for legal sufficiency.

The Office ofthe City Clerk has determined that the submitted Petition contains the signatures of at least 25% ofthe registered voters of Ward 23, Precinct 6, as required by Section 4-17-020 of the Chicago Municipal Code. Therefore, Alderman Silvana Tabares may introduce an ordinance to restrict all new or additional shared housing units and vacation rentals in Ward 23, Precinct 6.
