Please note that I am in receipt of the attached pending passage request from Alderman O'Shea for Two Council Orders for sign applications 100923499 and 100923497 for a large signs over 24 feet in height above grade at 9301 S Western Ave to be introduced at the January 26, 2022, City Council meeting which will be assigned to the Committee on Zoning, Landmarks, and Buildings Standards. Alderman O'Shea has stated that he is in full support of the Council Orders. I expect the Committee will recommend do pass on the items. It is understood that the applicant proceeds at their own risk in the event that the Council Orders do not pass City Council.

Comply with all applicable requirements pertaining lo the Public Way Use Permit, as set forth In Soction 10-28-015(e) and other applicable provisions, of Ihe Code, and In rules duly promulgated thereunder, Including the requirements let forth In those Terms ond Conditions;
Upon passage of an Ordinance authorlilng.the Issuance of the Public Way Use Permit, and thereafter upon renewal of such Permit, pay the applicable and non-refundable annual pormlt fee for such Permit;
Upon passage of an Ordinance authorizing the Issuance of the Public Way Use Permit, submit to BACP's Public Way Use Unit a Certificate of Insurance meeting the requirements In Section 10-28-012(e)(5), and thereafter, maintain such Insurance In full force and effect for the duration of the Permit;
Prior to renewing the Public Way Use Permit, resolve all "holds" that the City has placed on Ihe permittee's account ("account holds") for failure to resolve outstanding debt or for any other reason. Failure to do io will result In deloyt In processing the Issuance or renewal of Hie Public Way Use. Permit;
Install and maintain In good condition and repair, and safe for public travel, and free from mow. Ice and debris, all permitted Irem(s) encroaching In, over, under or ad|acent to the public way, as required by, and In accordance with, Section 10-28-015(e)(l) of the Code;
Be responsible for the coil of any work lhat the City performs In the event of the permittee's failure, neglect or refusal to perform ony of the permittee's legal obligations, as required by, and In accordance with. Section 10-28-015(e)(3) of the Code;
Be responsible.for, and pay for, the removal, relocation, alteration, repair, maintenance, and restoration of city-owned structures or appliances located In or ad|acenl to the" public way, which are necessary or appropriate on account of the permittee's use of the public way, os required by, and In accordance with, Section 10-28-015(e)(4) of the Code; and
Indemnify, defend, keep and save harmless the City, Its agents and employees against all claims, liabilities, kidgments, costs, damages and other expenses which Iii any way may arise or accrue against, be chargod to or recovered from the City, Its agents or employees to the extent required by, and In accordance with.
