Be it Ordained by the City Council of the City of Chicago:


SECTION 1. The Commissioner of the Chicago Department of Transportation, or any of her designees, is each hereby authorized and directed to approve a proposed Forty Four Commons Resubdivision, being a resubdivision of certain lots owned by Grand Boulevard Terraces, LLC ("Developer") in the block bounded by S. State Street, S. Wabash Avenue, E. 44th Street and E. 45th Street and legally described in the attached Plat of Resubdivision (Exhibit A, CDOT File: 03-03-21-3997), which, for greater certainty, is hereby made a part of this ordinance.


SECTION 2. The Commissioner of the Chicago Department of Transportation, is hereby authorized and directed to approve a dedication of certain property owned by the Developer in the block identified in Section 1, and legally described in Exhibit A. The Developer shall, at its sole expense, construct an alley on the to-be-dedicated property. The dedication is accepted upon the express condition that such alley be constructed according to the current version of the Chicago Department of Transportation's Regulations for Opening, Repair and Construction in the Public Way and its appendices, and as agreed to by the Developer in the Duty to Build Agreement, hereby attached as Exhibit C and made a part of this ordinance.


SECTION 3. A small opening of public land is also required, by and through the authority of the Department of Planning and Development, to complete the public alley on the subject block, such Plat of Opening being also hereby made part of this ordinance as Exhibit B. The improvement of said land with standard surface, and public lighting shall be completed at the sole expense of the Developer in compliance with the current version of the Chicago Department of Transportation's Regulations for Opening, Repair and Construction in the Public Way and its appendices, and as approved by, the CDOT Division of Electrical Operations.
