ORDINANCE

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

 

SECTION 1. Section 4-60-076 of the Municipal Code of the City of Chicago is hereby amended by deleting the language stricken, and by inserting the language underscored, as follows:

 

4-60-076 Outdoor Entertainment Venue liquor licenses - Special conditions.

(g) No Outdoor Entertainment Venue shall be located within 42-5-250 feet of any existing property that contains residences at the time that it applies for its licenses under Chapter 4-60 and Chapter 4-156, measured from the nearest property line of the property that contains residences to the nearest property line of the property containing the Outdoor Entertainment Venue: provided, however, that no Outdoor Entertainment Venue shall be located within a planned development that permits residential uses.

 

(h)                     A location eligible for an Outdoor Entertainment Venue liquor license shall not be
eligible for an outdoor patio license.

 

(i)                     No more than one Outdoor Entertainment Venues shall be authorized pursuant to a
license issued under this Section during anv license period.

 

 

SECTION 2. This ordinance shall take effect upon passage and publication.
