ORDINANCE
WHEREAS, the Illinois Constitution and the Illinois Governmental Cooperation Act empower and encourage units of local government to associate amongst themselves; and
WHEREAS, pursuant to an ordinance adopted by the City Council ("City Council") of the City of Chicago (the "City") on June 6, 2012 and published at pages 28383-28484 of the Journal of the Proceedings of the City Council (the "Journal") of such date, the City entered into certain agreements related to the consolidation of workforce development efforts of the City and the County of Cook (the "County") under the Federal Workforce Investment Act (the "WIA"); and
WHEREAS, workforce development efforts previously funded under the WIA are now funded under the Federal Workforce Innovation and Opportunity Act and the regulations issued thereunder (as amended, supplemented, modified or replaced, collectively, the "WIOA"); and
WHEREAS, pursuant to an ordinance adopted by the City Council on October 5, 2016 and published at pages 34274 - 34363 of the Journal of such date, the City entered into certain agreements (the "WIOA Agreements") related to the continued collaboration regarding workforce development efforts of the City and the County under the WIOA; and
WHEREAS, one of the WIOA Agreements is an agreement (the "Fiscal Agent Agreement") pursuant to which the Mayor of the City of Chicago (the "Mayor") and the President of the Cook County Board of Commissioners (the "President") designated the Chicago-Cook Workforce Partnership as the grant subrecipient and fiscal agent for federal WIOA funds; and
WHEREAS, pursuant to an ordinance adopted by the City Council on June 17, 2020 and published at pages 18303 - 18305 of the Journal of such date, the City executed extensions to the Fiscal Agent Agreement, with the final extension expiring June 30, 2022; and

WHEREAS, the Mayor and the President intend to continue collaboration regarding workforce development efforts under WIOA; and
WHEREAS, legislative approval of certain intergovernmental agreements consistent with the continuing collaboration regarding local workforce development efforts is in the best interests of the City and its residents; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. All of the recitals above are expressly adopted as legislative findings of the City Council and are incorporated herein and made hereby a part of this Ordinance.
SECTION 2. The City Council hereby approves, and the Mayor is authorized to execute on behalf of the City, subject to the approval of the Corporation Counsel as to form and legality, (a) one or more extensions to the Fiscal Agent Agreement, provided that the final expiration date, after giving effect to such extensions, shall be not later than June 30, 2029, (b) one or more agreements under which the Mayor and the President would designate a new fiscal agent, or one or more successor fiscal agents, under WIOA, subject to the appropriation and availability of funds, provided that the final expiration date of such agreement(s), including any extensions, shall be not later than June 30, 2029, and (c) amendments to the Fiscal Agent Agreement, the Intergovernmental Agreement dated as of July 1, 2015 between the City and the County and any related agreements, and such other supporting agreements or documents, including without limitation one or more data sharing agreements, necessary or desirable to update reporting requirements and otherwise to reflect the actions described in this Section 2.
SECTION 3. This ordinance shall be effective upon passage and approval.
