ORDINANCE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. Section 2-100-030 of the Municipal Code shall be amended by adding the underscored language, as follows:

2-100-030 Commissioner - Powers and duties.

The Commissioner of Streets and Sanitation shall have supervision of the sanitation of the public ways of the city and the lighting thereof except where such improvement is to be paid for wholly or in part by special assessment; the cleaning of public ways and the removal of garbage, refuse and waste, the removal of any article or thing which may encumber or obstruct any public way; the establishment and maintenance of a managed native and pollinator garden registry as provided in Section 10-32-055; the administration and operation of the Chicago skyway toll bridge; the administration of a private hauling complaint system pursuant to Section 8-32-130. in conjunction with any additional departments necessary for administering such a system; and the installation and inspection of all-electrical equipment not specifically provided for by other sections of this ordinance.

SECTION 2. Chapter 11-5 of the Municipal Code shall be amended by adding the underscored language and removing the stricken language, as follows:

11-5-210 Record keeping - Required.

Private haulers shall maintain complete and accurate records containing the following information: (1) the total tonnage of recyclable material collected by the private hauler from the totality of the private, hauler's refuse collection customers within the city during each calendar year; (2) the name and address of each facility to which the private hauler delivered any percentage of such collected recyclable material during each calendar year; (3) the percentage of recyclable material delivered each calendar year by the private hauler to each facility identified pursuant to item (2) of this section; (4) all Global Positioning System. Geographic Information System, or other electronic tracking records that demonstrate the place and time of each dispatch for service: and {4}/J>1 any other information that the Commissioner may require in duly promulgated rules. The records required by this section shall be kept on file by the private hauler for a period of three years.

SECTION 3. Section 8-32-130 ofthe Municipal Code shall be amended by adding the underscored language, as follows:

8-32-130 Loading and unloading operations.

No person shall undertake or cause the loading, unloading, opening, closing or other handling of boxes, crates, containers, building materials, garbage cans, dumpsters or similar objects between the hours of 10:00 P.M. and 7:00 A.M. in such a manner as to cause a noise disturbance within a residential district or within a noise sensitive zone. The City shall use a 311 complaint system to collect resident complaints of private haulers, licensed pursuant to Chapter 11-5 of theMunicipal Code, that are operating outside ofthe hours listed in this Section. Private haulers may use data collected pursuant to Sections 11-5-210 and 11-5-220 of the Municipal Code to dispute any such violations of this section.

SECTION 4. This ordinance shall, be in full effect on January 1, 2023.
