ORDINANCE

 

 

WHEREAS, there is a legitimate interest in the timely payment of benefits due to the widows and surviving relatives of fallen Chicago Police Officers; and

 

WHEREAS, the Municipal Code of the City of Chicago does not currently provide a timeframe in which these benefits must be awarded; and

 

WHEREAS, it is within the power of the City Council to now do so; NOW THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

 

SECTION 1. Section 2-84 of the Municipal Code of the City of Chicago is hereby amended by adding new language to Section 2-84-450 as follows:

2-84-450 Salary to widow or other dependents.

 

The salary of any police officer killed in the line of duty shall continue for a period of one year commencing from the date of the death of the deceased police officer and shall be paid out of the specified fund appropriated therefor included in the general finance section of the Annual Appropriation Ordinance for the year 1967 and subsequent years to the widow of the deceased police officer, or in the absence of a widow, to the guardian or person standing in loco parentis of dependent minor children, or in the absence of a widow or minor children, to dependent parents who were residents in the deceased police officer's household at the time of the injury which resulted in his death. This section shall be retroactive to January 1, 1965. The department of police must begin to disburse all benefits appropriately due a widow or other beneficiary within 45 days. If the department of police fails to act within 45 days, benefits shall be awarded presumptively. This shall apply to all pending claims from the date they were filed.

SECTION 2. This ordinance shall take full force upon passage and publication.
