WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) ofthe 1970 Constitution ofthe State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the City has experienced a significant loss of industry and jobs, in recent years, accompanied by a corresponding erosion of its tax base, due in part to industrial firms' inability to acquire additional property needed for their continued viability and growth; and
WHEREAS, many industrial firms adjoin streets and alleys that are no longer required for public use and might more productively be used for plant expansion and modernization, employee parking, improved security, truck loading areas or other industrial uses; and

WHEREAS, the City can strengthen established industrial areas and expand the city's jobs base by encouraging the growth and modernization of existing industrial facilities through the vacation of public streets and alleys for reduced compensation; and

WHEREAS, the properties at 4608-4658 W. Arthington Street, are owned by K-Town Business Centre, LLC, an Illinois limited liability company ; and
WHEREAS, the properties at 4607-4659 W. Arthington Street, 901-911 S. Kilpatrick Avenue, 918-923 S. Kilpatrick Avenue, and 4610-4658 W. 5th Avenue are owned by K-Town Business Centre 2, LLC an Illinois limited liability company; and
WHEREAS K-Town Business Centre, LLC, an Illinois limited liability company, and K-Town Business Centre 2, LLC an Illinois limited liability company shall for purposes of this ordinance collectively be known as "the Developers"; and
WHEREAS, the Developers employ 40 full-time employees; and
WHEREAS, the Developers propose to use the portion of the street and alley to be vacated herein for access to, truck routing for and construction of a 60,000 square foot manufacturing and distribution warehouse; and
WHEREAS, the City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent of public use and the public interest to be subserved is such as to warrant the vacation of part of public street and alley described in the following ordinance; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 2. The Commissioner of the Chicago Department of Transportation is hereby authorized to accept and approve a restrictive covenant or similar instrument restricting the use and improvement of the public way vacated in Section 1 of this ordinance to industrial uses and for such use and improvements that are accessory as that term is defined in the Chicago Zoning Ordinance. The reversion restriction in the covenant agreement or instrument shall be for a term of 40 years and upon breach of such restriction the public way herein vacated shall revert to the City and be subject to the terms and conditions of the dedication by which it has been heretofore held by the City. The use restriction shall be in place into perpetuity unless released subject to payment of appraised compensation to the City.

SECTION 3. The City of Chicago hereby reserves for the benefit of Commonwealth Edison, AT&T/SBC, Comcast and their successors or assigns, a non-exclusive utility easement to operate, maintain, construct, replace and renew overhead wires, poles, and associated equipment and underground conduit, cables, and associated equipment for the transmission and distribution of electrical energy, telephonic and associated services under, over and along the street and alley herein vacated, with the right of ingress and egress. The grade of the vacated public way shall not be altered in a manner so as to interfere with the operation and maintenance of Commonwealth Edison, AT&T/SBC, and/or Comcast facilities. No construction, buildings, permanent structures or obstructions shall occur or be placed over the area herein vacated without express written release of easement by the involved utilities. Any future Developer-prompted relocation of facilities lying within the area being vacated will be accomplished by the involved utility, and be done at the expense of the beneficiary of the vacation, its successors or assigns.

SECTION 4. The City of Chicago hereby reserves for the benefit of The Peoples Gas Light and Coke Co. ("Peoples Gas") an easement to operate, maintain, repair, renew and replace existing underground facilities and to construct new facilities in all of the area to be vacated, with the right of ingress and egress at all times for any and all such purposes. It is further provided that no buildings or other structures shall be erected upon or over said easement herein reserved for Peoples Gas or other use made of the said area which would interfere with the construction, operation, maintenance, repair, removal, or replacement of said facilities, or the construction of additional facilities. No construction, buildings, permanent structures or obstructions shall occur or be placed over the area herein vacated without express written release of easement by the involved utility. Any future vacation- beneficiary prompted relocation of Peoples Gas facilities lying within the area herein vacated will be accomplished by Peoples Gas, and completed at the expense ofthe Developers, their successors or assigns

SECTION 5. The Developers acknowledge that the currently public Department of Water Management 8 inch water main, hydrants and appurtenances within W. Arthington Street to be vacated shall become the private property and the maintenance responsibility of the Developers. The Developers further acknowledge that they shall be responsible for adhering to certain terms of the Chicago Department of Water Management, as detailed in the attached correspondence dated August 17, 2022, hereby attached and made a part ofthis ordinance as EXHIBIT B.
SECTION 6. The Developers acknowledges that the Department of Water Management 12 inch public sewer and associated structures in W. Arthington Street within the area to be vacated shall become the Developers' private property and maintenance responsibility. In the event that the Developers wish to abandon, modify or install new facilities, plans must be reviewed, approved and permitted by the Department of Water Management, Sewer Design Section, prior to the commencement of. any work. The Developers shall provide the Department of Water Management, Sewer Design Section, with as-built drawings submitted within 45 days of completion.
SECTION 7. The vacation herein provided for is made upon the express condition that within 180 days ofthe City Council passage ofthis ordinance, the Developer shall pay to the City Treasury of the City of Chicago, a quoted security deposit equal to the costs of the Developer's work to public paving, curb, and related appurtenances, in accordance with the most current version of the Chicago Department of Transportation's Regulations for Opening. Repair and Construction in the Public Way and its appendices. Upon completion of work, a request for final field inspection and approval of the Developer's construction, shall be made to the CDOT Division of Infrastructure Management, Construction Compliance Unit, Room 905 City Hall, prior to return of said security deposit less any service fee.

SECTION 8. The vacation herein provided for is made under the express condition that the Developers, and their successors and assigns, shall hold harmless, indemnify and defend the City of Chicago from all claims related to said vacation.
SECTION 9: The vacation herein provided for is made upon the express condition that within 180 days after the passage of this ordinance, the Developers shall pay or cause to be filed for recordation with the Office of the Cook County Clerk / Recordings Division, a certified copy of this ordinance, together with a restrictive covenant, complying with Section 2 of this ordinance and approved by the Corporation Counsel, and the attached plat approved by the Chicago Department of Transportation's Superintendent of Maps and Plats.

SECTION 10. This ordinance shall take effect and be in force from and after its passage and publication. The vacation shall take effect and be in force from and after the recording of the published ordinance and approved plat.

Dear Mr. Kalayil:
This letter is in response to your inquiry dated June 10, 2022, concerning the proposed vacation. This letter supersedes the previous letter regarding VD-103969 dated December 14,2020. After reviewing our records, we have determined the following:
I) The Department of Water Management - Water Section
There is approximately 550 feet of 8-inch water main with two hydrants installed in 1998 within the proposed vacation.
For the vacation to be approved by the Water Section, this water main must be abandoned and the requirements of the letter to The Will Group dated June 10, 2022, attached hereto, must be complied with, namely:
For the hydrant removals, the DWM will be responsible for removal of the hydrants including excavation and backfill of the excavated areas after construction, but The Will Group will be responsible for all final restoration.
For the water main abandonment, the DWM will perform all work, including restoration, to disconnect the abandoned main from the water main system.
The estimated cost for the DWM to perform its scope of work is $60,280.00. This estimate is based on current rates for labor (straight time), material, equipment and overhead charges, but actual costs will be submitted for payment upon completion of the work.

All water services no longer in use must be permanently terminated as part of the proposed development by permit per DWM Standards.
Because the existing water main cannot be located within private property (the vacated street), this work must be done before the vacation can be approved.
The existing 8-inch water main in W Arthington Street from S Kilpatrick Avenue to 524 feet east of the east property line of S Kilpatrick Avenue is not fully amortized. The total fixed unamortized cost for this existing 8-inch water main abandonment is $58,467.29.
DWM acknowledges receipt of payment ofthe estimated costs in the amount of $118,747.29 ($60,280.00 + $58,467.29) on My 12, 2022 and has no objection to the proposed street vacation once the DWM water facilities have been abandoned.
There are no water facilities within the limits of the area proposed for alley vacation. Therefore, the Water Section has no objection to the proposed alley vacation.

The Department of Water Management - Sewer Section
Per Plat of Vacation, there are a total of two (2) parcels proposed for vacation and represented as 16-ft wide alley and W Arthington St.
16-ft wide alley: Based on sewer records, there are no public sewer facilities within the limit of the alley proposed for vacation. Therefore, the Sewer Section has no objection to the proposed vacation ofthe alley.
Arthington St: Based on sewer records, there is a 12-inch public sewer running east-west with associated structures onW Arthington St from Belt Railroad to S Kilpatrick Ave. There are two adjacent parcels (PINs -022, -040) owned by Belt Railway Company and located on both sides of the proposed vacation of W Arthington St. The beneficiary has easement agreements with Belt Railway Company on both parcels.
To approve the proposed vacation of W Arthington St, the beneficiary must assume ownership ofthe sewer and appurtenances within the area to be vacated. These sewer facilities will then be the private property of the beneficiary. The beneficiary must assume all liability for these facilities upon abandonment and be responsible for all maintenance and repairs for reuse.

This correspondence supersedes the previously issued correspondence dated November 20, 2020. This correspondence is in response to an Office of Underground Coordination request for the proposed street vacation for the subject project.-

The Department of Water Management - Water Section
This Department will be performing corrective work within the subject project limits. Please contact the Term Agreement Construction Manager at TACM@ctrwater.net to coordinate construction. The Will Group must not complete final restoration until the corrective work by DWM has been completed.

This Department maintains an existing 8nnch water main located at approximately 23 feet south of the north property line of W Arthington Street. In order to accommodate the proposed vacation of W Arthington Street, from S Kilpatrick Avenue to 602 feet east of the east property line of S Kilpatrick Avenue, the DWM must abandon in place approximately 550 feet of the existing 8-inch water main and remove two (2) existing fire hydrants.

Regarding the fire hydrant removals, the DWM will be responsible for excavation and backfill of the excavated areas after construction, but The Will Group shall be responsible for all final restoration. Regarding tfie work to abandon the existing 8-inch water main, the DWM will perform the final restoration associated with this work at W Arthington Street and S Kilpatrick Avenue. The estimated cost for the DWM to perform its scope of work is $60,280.00. This estimate is based on current rates for labor (straight time), material, equipment and overhead charges,, but actual costs will be submitted for payment upon completion of the work.

Two (2) separate deposits in the amount of $60,280.00 and $58,467.29 payable to the City of Chicago is required. In order to receive an invoice for this deposit, send a copy of this letter to BPermits@cityofchicago.org via email. Print two (2) copies of each invoice and bring the invoices for payment to a City of Chicago payment center. Once payment has been made, the applicant should forward a copy of the receipt, stamped invoice, and copy of this letter to BPermits@cityofchicago.org . Upon receipt of the proof of payment, DWM will respond with copy of the BPermit.
It is required that the Force Account Construction Manager be contacted at FACM@ctrwater.net two (2) weeks prior to the anticipated construction date so a DWM crew can be assigned to the project. '

The minimum vertical clearance (edge-to-edge) from all water mains is 18 inches. For feeder mains (water mains 16-inches and larger), the minimum horizontal clearance (edge-to-edge) is five (5) feet, and for grid mains (water mains less than 16-inches), the minimum horizontal clearance (edge-to-edge) is three (3) feet. No proposed above ground facility (tree, planter box, light pole, etc.) can be closer than five (5) feet (edge-to-edge) from a water main or closer than three (3) feet (edge-to-edge) from a water service. Should the DWM require access to its facilities, it will not be responsible for the costs to remove or support any above ground structures adjacent to its facilities.

All sewer installations must meet IEPA separation requirements for water and sewer pipes. All proposed/replaced sewer laterals from catch basins/inlets, sewer mains, and private drains (collectively known as "sewer facilities") that are parallel to water mains, services or fire hydrant leads (collectively known as "water facilities") that are less than 18 inches below the water facility and have less than 10 feet of horizontal separation from the outside edge of the water facility must be made out of ductile iron/water main quality pipe for 10 feet on either side of the outside edge of the water facility. Additionally, all sewer facilities that cross perpendicularly below water facilities with less than 18 inches vertical separation must be made out of ductile iron/water main quality pipe for 10 feet on either side of the outside edge of the water facility. If any sewer facility crosses perpendicularly above a water facility, then the sewer facility shall be at least 18 inches above the water facility and the sewer facility must be made out of ductile iron/water main quality pipe for 10 feet on either side of the outside edge of the water facility. Sewer laterals that require ductile iron/water main quality pipe shall be ductile iron/water main quality pipe from the catch basin to a point 10 feet beyond the edge of the water facility.
In no case shall the installation of any proposed facility be closer than five (5) feet from a fire hydrant or fire hydrant lead. All new curb installation adjacent to fire hydrants must be painted 'safety yellow' for 15 feet on each side of the fire hydrant except where the 15 foot dimension intersects a crosswalk, driveway or similar feature.

If construction requires the use of water from a City fire hydrant, or adjustments or repairs are required to any City sewer facilities in proximity to the project site, permits must be obtained from the Department of Water Management, Water and Sewer Sections.

Proposed trees must not be planted within five (5) feet of the exterior pipe wall for all water mains 24-inch in diameter and larger. This 5-foot rule excludes mains that are separated from the tree by a hardscape feature or other root growth limiting conditions such as water mains located in the street.

This Department discourages tree planting over water mains that are less than 24-inches in diameter located in the parkway, but if necessary will allow trees with a maximum mature height of 30 feet and a maximum mature root depth of 214 feet. Potential plantings that meet this requirement include the following:
Ornamental shrubs or bushes meeting the mature height and mature root depth discussed above. 1
Flowers or other non-woody herbaceous plants.
Above ground, movable planting containers that can be relocated by the owner of the plantings in the event that access to the water main is required.
Existing trees planted above water mains that do not meet these requirements do not need to be removed. However, if such existing trees are removed, all proposed trees installed in their place must meet the above-mentioned requirements. Should it be necessary for the DWM to access any of its facilities, the Department shall only be responsible for typical pavement, sidewalk, and hydroseed restoration.

Extreme caution is to be taken to ensure that no facility owned and maintained by this Department is damaged during construction. If damage occurs to any facilities, The Will Group will be held responsible for the cost of repairing or replacing them.
Please note that the details described above are valid for 90 days from the date of this letter, after which time, The Will Group will be responsible for re-submitting plans to this Department for review and revision of the estimate of cost, as needed. Failure to comply with the provisions in this correspondence may result in additional expenses to the proposed project to verify that all work conforms to DWM's standards.

"Principal officers means the president, chief operating officer, executive director, chief financial officer, treasurer or secretary of a legal entity or any person exercising similar authority.
