ORDINANCE

WHEREAS, in 2005, the Illinois General Assembly published findings that HIV/AIDS in the African-American community is a crisis separate and apart from the overall issue of HIV/AIDS in other communities; and

WHEREAS, to mitigate this ongoing crisis, the legislature passed Public Act 94-629 that established the African-American HIV/AIDS Response Fund used for grants to programs dedicated to preventing the transmission of HIV in impacted African American communities as well as other programs and activities including, but not limited to, preventing and treating HIV/AIDS, the creation of an HIV/AIDS service delivery system, and the administration of the act; and

WHEREAS funding comes from appropriations by the General Assembly, federal funds, and other public resources to provide funding for communities in Illinois to create an HIV/AIDS service delivery system that reduces the disparity of HIV infection and AIDS cases concentrated in impacted African-American neighborhoods; and

WHEREAS, since more than 50% of all recently diagnosed cases affect African-American Chicagoans, a City of Chicago African-American HIV/AIDS Response Fund administered by the Department of Public Health shall be created. Furthermore, a line-item shall be added to the City of Chicago's Department of Health budget titled "Chicago African-American HIV/AIDS Response Fund". An equitable portion of funds appropriated annually by the City of Chicago for HIV/AIDS mitigation shall be set aside to fund this line item; and

WHEREAS, when providing grants pursuant to this fund, the Department of Public Health shall give priority to the development of comprehensive medical and social services in a clinical setting to African-Americans at risk of infection from or infected with HIV/AIDS in neighborhoods of Chicago determined as having the highest concentration of African-Americans living with this disease and

WHEREAS the Chicago Department of Public Health, acknowledging the real challenges that exist for smaller, non­clinical organizations, will actively support minority-led organizations by (a) expanding funding opportunities where possible, (b) extending technical assistance in the funding application process, (c) providing capacity building assistance to strengthen core infrastructure, and (d) creating opportunities for small organizations to expand their services to include areas where more funding may be available and explore alternative funding pathways including partnerships; now therefore

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. The above recitals are hereby incorporated by reference as if fully set forth in this ordinance and are adopted as the findings of the City of Chicago City Council.

SECTION 2. Chapter 2-112-110 ofthe Municipal Code of the City of Chicago is hereby amended by adding new language underlined as follows:

The Commissioner of Public Health shall have the following powers and duties:

(a) Public health related powers and duties
To enforce all the laws of the state and provisions of this Code in relation to matters pertaining to the public health and sanitary conditions of the City, including Section 8-16-024;
To enforce all regulations of any federal, state, or local authority with power to make regulations concerning the public health;

To participate or otherwise engage in the City's emergency preparedness and emergency response activities.
To administrate the Chicago African-American HIV/AIDS
Response Fund.

(c) To do any and all other acts which may be necessary for the implementation of other powers conferred on the Commissioner under this Code.

SECTION 3. A new Chapter 7-20-50 ofthe Municipal Code ofthe City of Chicago is hereby created by adding new language underlined as follows:

7-20-50 Chicago African-American HIV/AIDS Response Fund

A Chicago African-American HIV/AIDS Response Fund shall be created, and an equitable portion of funding appropriated in the Citv of Chicago's annual budget for HIV/AIDS mitigation shall be set aside as a line-item to be used bv this fund. Monies distributed from this fund shall be used for grants to HIV/AIDS community-based organizations who serve communities whose majority is African-American and provide medical and social services in a clinical setting.

SECTION 4. This ordinance shall take full effect upon its passage and publication.
