Since 2018, Goose Island Holiday Pop Ups, LLC (the "Applicant") has operated seasonally themed pop-up attractions at the property located at 1440-1464 N. Magnolia Avenue / 1241-1259 W. Le Moyne Street / 1439-1461 N. Elston Avenue (the "Property"). Seasonal pop-ups have included a rodeo-themed summer pop-up with go-karts, a Halloween and pumpkin-patch themed fall pop-up with a corn maze, and a holiday themed winter pop-up with an ice-skating rink. These pop-up attractions have been authorized through Department of Cultural Affairs and Special Events-issued special event permits and Department of Business Affairs and Consumer Protection-issued special event liquor and pop-up retail business licenses. Due to the special event permitting and licensing, the Applicant has not provided off-street parking historically.

The Property is 1.68 acres (73,132 square feet) in size and is located within the North Sub-Area of the North Branch Industrial Corridor. The Property is currently unimproved by any permanent building structure and is located in an M3-3 Heavy Industry District. The Property is owned by Chicago Title Land Trust Company as Successor Trustee to LaSalle Bank National Association as Successor Trustee to American National Bank and Trust Company of Chicago as Trustee under Trust Agreement dated July 12, 1999 and known as Trust number 125216-05 (the "Owner"), which leases the Property to the Applicant for such seasonal pop-up attractions.

The Applicant would like to continue to utilize the Property for rotating seasonal pop-up attractions, but with the changing nature of the North Branch Industrial Corridor and the area at-large, it would like to obtain City-issued business licensing for the pop-up attraction business activities, which include:
Sports and Recreation, Participant - Outdoor
Tavern
Outdoor Patio
Retail Sales, General

In order to pursue business licensing that corresponds to these uses, the Applicant proposes a zoning map amendment for the Property to a C3-1 Commercial, Manufacturing and Employment District pursuant to §§ 17-13-0300 and 17-13-0402 of the Chicago Zoning Ordinance. The Applicant would also request a 100% reduction in the off-street parking requirement to continue operating at the Property with zero parking spaces, which is authorized through the recently passed Equitable Transit Oriented Development Ordinance and the Property's proximity to the North Avenue bus line corridor (which is approximately 650 feet away).

The proposed zoning map amendment would trigger the Industrial Corridor System Conversion Fee, pursuant to § 16-8 of the Municipal Code of Chicago. With a net site area of 73,120 square feet, the estimated Conversion Fee would be $895,867.00.


Approval Criteria

17-13-0403 Review and Decision-Making Criteria. In reviewing and making decisions on proposed zoning map amendments within industrial corridors, review bodies and decision­making bodies must consider the criteria established in Sec. 17-13-0308 as well as whether the proposed rezoning would adversely affect the continued industrial viability of the industrial corridor. With respect to industrial viability, review bodies and decision-making bodies must consider the following factors:
17-13-0403-A the size ofthe district;
The North Branch Industrial Corridor is 760.86 acres in size; the Property is 1.68 acres in size, which reflects 0.002% ofthe overall industrial corridor district.
17-13-0403-B the number of existing firms and employees that would be affected;
The Property is currently unimproved by any permanent building structure. Furthermore, for the past five years, the Applicant has operated seasonally themed pop-up attractions at the Property. The Applicant seeks to continue to utilize the Property for rotating seasonal pop-up attractions, but to do so through more permanent business licensing for the pop-up business activities. Accordingly, no existing industrial firms or employees would be affected by this proposed zoning map amendment.
17-13-0403-C recent and planned public and private investments within the district;
The proposed zoning map amendment would trigger the Industrial Corridor System Conversion Fee, pursuant to § 16-8 ofthe Municipal Code of Chicago. With a net site area of 73,132 square feet, the estimated Conversion Fee would be $895,867.00, a significant private financial investment into the area to preserve and enhance the industrial base, support new and expanding industrial uses, and to help provide a stable future for manufacturing and industrial employment within the North Branch Corridor.
17-13-0403-D the potential of the district to support additional industrial uses and increased manufacturing employment;
The establishment of the North Branch Corridor Overlay District by City Council in July 2017 created three subdistricts within the new overlay district. Here, the Property is located within the North subdistrict. Accordingly, rezonings within this
subdistrict._to_B_(Business)...and C (Commercial) zoning_districts_ar.eexpressly
allowed. See MCC 17-7-0405-A. This is consistent with the zoning map amendment being proposed by the Applicant.

17-13-0403-E the proportion of land in the district currently devoted to industrial uses;
Based upon the North Branch Framework, published in May 2017 by the City of Chicago, in 2016, industrial and manufacturing land use constituted 23% ofthe North Branch Industrial Corridor.
17-13-0403-F the proportion of land in the district currently devoted to non-manufacturing uses; and
Based upon the North Branch Framework, published in May 2017 by the City of Chicago, in 2016, non-and manufacturing land uses constituted 77% ofthe North Branch Industrial Corridor, including transportation and utility uses making up 30%, commercial and retail making up 16%, and vacant land making up 13% (all other land use groups were six percent or less).
17-13-0403-G the area's importance to the city as an industrial district.
The North Branch Industrial Corridor has been deemed "an important economic engine and vital job center within the City of Chicago." See North Branch Framework, page 6. Furthermore, the Property is located within the North Sub-Area ofthe North Branch Industrial Corridor. This Sub-Area has been identified as an area already under transition to a more mixed-use environment and one to accommodate future commercial land uses, such as those being proposed by the Applicant through this zoning amendment application.

This Appendix is to be completed only by (a) the Applicant, and (b) any legal entity which has a direct ownership interest in the Applicant exceeding 7.5%. It is not to be completed by any legal entity which has only an indirect ownership interest in the Applicant.

Under MCC Section 2-154-015, the Disclosing Paity must disclose whether such Disclosing Paity or any "Applicable Party" or any Spouse or Domestic Partner thereof currently has a "familial relationship" with any elected city official or department head.
