Your Committee on License and Consumer Protection, having under consideration a substitute ordinance introduced by Alderman Margaret Laurino (which was referred on November 10, 2010), to amend Section 4-60-022 of the Municipal Code of Chicago regarding the prohibition of licenses for the sale of alcoholic liquor in portions of the 39th Ward, begs leave to recommend that Your Honorable Body pass the substitute ordinance which is transmitted herewith.
This recommendation was concurred in by a viva voce vote of the members of the committee on December 22, 2010.

SUBSTITUTE ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. The City Council finds that the area described in Section 2 of this ordinance is adversely affected by the over-concentration of businesses licensed to sell alcoholic liquor within and near the area.
SECTION 2. Section 4-60-022 of the Municipal Code of Chicago is hereby amended by replacing subsection 4-60-022 (39.84), which was previously deleted as shown in the Journal of the Proceedings of March 18, 2009, on pages 56096 through 56098, with the following underscored text:

4-60-022 (39.84) On North Elston Avenue, from West Berteau Avenue to West Montrose
Avenue.

SECTION 3. Pursuant to the requirements of Section 4-60-021 (c)(4) of the Code, this ordinance shall be in full force and effect, following passage and publication, on December 8, 2010 in the event that publication occurs before December 8, 2010. In the event that publication of this ordinance occurs after December 8, 2010, this ordinance shall take effect upon passage and publication.
