To the President and Members of the City Council:
Your Committee on Transportation and Public Way begs leave to report and recommend that Your Honorable Body pass An ordinance for a proposed amended vacation ordinance for the release of an easement as provided in Section 2 of the Vacation Ordinance passed on September 5,  2007     (C.J.P.  7319-7322).    The Department of Water Management has determined that the City no longer needs the easement and the building restriction.    This ordinance was referred to the Committee on February 9, 2011.
This recommendation was concurred unanimously by a viva voce vote of the members of the Committee with no dissenting vote.

WHEREAS,  The City Council ofthe City of Chicago, after due investigation and consideration, has determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of parts of a public street and public alleys described in the following ordinance; now, therefore,
Be it Ordained by the City Council ofthe City of Chicago;
SECTION 1.   All that part of West 14lh Place lying south ofthe south of Lot 30, lying north of the north line of Lot 69, lying west of a line drawn from the southeast corner of the southeast corner of Lot 30 to the northeast corner of Lot 69 and lying east of a line drawn from the southwest coiner of Lot 30 to the northwest corner of Lot 69 in Stinson's Subdivision of Block 17 in the subdivision of Section 19, Township 39North, Range 14, East of the Third Principal Meridian, in Cook County, Illinois,
Also
all that part of West 14lh Place lying south of the south line of Lots 31 to 49, both inclusive, lying north ofthe north line of lots 50 to 68, both inclusive, lying west of a line drawn from the southeast corner of Lot 31 to the northeast corner of Lot 68 and lying east of a line drawn from the southwest corner of Lot 49 to the northwest corner Lot 50 all in Stinson's Subdivision of Block 17 in the subdivision of Section 19 aforesaid,

Street, also all ofthe east/west 16 foot public alley in the block bounded by West 14 Street, West 14lh Place, South Paulina Street and South Ashland Avenue along with all of the east/west 16 foot public alley bounded by West 14th Place, West 15th Street, South Paulina Street, and South Ashland Avenue as shaded and indicated by the words "To Be Vacated" on the drawing hereto attached, which drawing for greater certainty is hereby made a part of this ordinance, be and the same are hereby vacated and closed, in as much as the same are no longer required for public use and the public interest will be subserved by such vacations.
SECTION 2.  The vacations herein provided for are made upon the express condition that within three hundred sixty-five (365) days after the passage of this Ordinance, the Illinois Medical District Commission shall deposit in the City Treasury of the City of Chicago a sum sufficient to defray the costs of removing paving and curb returns and constructing sidewalk and curb across the entrances to those parts of West 14lh Place hereby vacated similar to the sidewalk and curb along the westerly line of South Ashland Avenue. The precise amount ofthe sum so deposited shall be ascertained by the Commissioner of Transportation, after such investigation as is requisite.
SECTION 3.  The vacations herein provided for are made upon the express condition that within three hundred sixty-five (365) days after the passage of this ordinance, The Illinois Medical District Commission shall file or cause to be filed for record in the Office ofthe Recorder of Deeds of Cook County, Illinois a certified copy of this ordinance, together with an attached drawing approved by authorized staff of the Maps and Plats Unit of the Department of Transportation.
SECTION 4. This ordinance shall take effect and be in force from and after its passage.

Pursuant to a request from the Illinois Medical District, we are transmitting herewith for your review and approval as to form and legality an original and three (3) copies of a proposed amended vacation ordinance for the release of an easement as provided in Section 2 of the Vacation Ordinance passed on September 5, 2007 (C.J.P. 7319-7322). The Department of Water Management has determined that the City no longer needs the easement and the building restriction. The easement area is located in the 2nd Ward.

AMENDED VACATION ORDINANCE
WHEREAS, the City of Chicago ("City") is a home rule unit of government by virtue of the provisions of the Constitution of the State of Illinois of 1970, and as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the City passed an ordinance on September 5, 2007 (C.J.P. 7319-7322) ("Vacation Ordinance") vacating certain rights of way, including in part, a portion of West 14 Place between South Paulina Street and South Ashland Avenue ("Vacated Street"); and
WHEREAS, Section 2 of the Vacation Ordinance required the Illinois Medical District ("IMD") to reserve as a right-of-way an existing sewer and for the installation of any additional sewers or other municipally-owned service facilities now located or which in the future maybe located in those parts of West 14th Place which are located in the Vacated Street. It further provides that the IMD is prohibited from erecting buildings or other structures on the Vacated Street; and
WHEREAS, IMD has requested that the City remove the easement for existing sewers and release the building restriction; and
WHEREAS, the Department of Water Management has determined that the City no longer needs the easement and the building restriction; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1.   The forgoing recitals are hereby incorporated herein and adopted as the findings of the City Council.
SECTION 2. The Vacation Ordinance is hereby amended by deleting Section 2 and from the Vacation Ordinance and renumbering the remaining sections accordingly.
SECTION 3. This ordinance shall take effect and be in force from and after its passage and approval.
