Ordered, that the Commissioner of Department of Business Affairs and Consumer Protection is hereby authorized to issue a permit to TONY'S BURRITO MEX, INC (Permittee) to construct, maintain, and use two (2) Awning(s) over the public way attached to the structure located at 1957 W. Belmont Ave. for a period of five (5) years from and after 06/28/2009 in accordance with the ordinances of the City of Chicago and the plans and specifications filed with the Commissioner of Transportation and approved by the Commissioner of Buildings and the Division Marshal in charge of the Bureau of Fire Prevention. Said Awning(s) shall not exceed one (1) @ nineteen point five (19.5) feet in length and four (4) feet in width, one (1) @ sixteen point one six (16.16) feet in length and four (4) feet in width. The Permittee shall pay to the City of Chicago as compensation for the privilege Number 1087840 the sum of $100.00 per annum, in advance.
In the event the Permittee transfers title or vacates the premises, the Permittee shall, nevertheless, remain liable to the City of Chicago for the annual compensation until the Awning(s) is removed. The Permittee shall renew the privilege herein granted to the date of expiration. The Permittee shall protect, defend, indemnify and hold harmless the City of Chicago, its officers, agents and employees, against and from any expense, claim controversy, damage, personal injury, death, liability judgment, or obligation arising out of the construction, repair, replacement, cleaning, use maintenance or operation of the Awning(s) arising out of and including the passive negligence of the City of Chicago.
This grant of privilege in the public way shall be subject to the provisions of Section 10-28-075 and all other required provisions of the Municipal Code of Chicago.
