At the request of the Commissioner of Cultural Affairs and Special Events, I transmit herewith an ordinance amending Chapter 2-28 of the Municipal Code regarding the advisory board on cultural affairs.

ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. Chapter 2-28 of the Municipal Code is hereby amended by adding the language underscored and by deleting the language struck through, as follows:
2-28-010 Establishment - Composition.
There is hereby created and established an executive department of the municipal government of the City of Chicago which shall be known as the department of cultural affairs and special events. Said department shall embrace a commissioner, an executive director of special events, an advisory board council, and such employees as the city council may provide by the annual appropriation ordinance.
2-28-040 Advisory board council- Created - Appointment of members.
There is hereby created an advisory board council on cultural affairs and special events. The board council shall consist of 24 30 members appointed by the mayor, by and with the consent of the city council and. The advisory council shall advise the commissioner on matters relating to the city's cultural affairs of the city and special events, and support the commissioner's efforts to expand the reach and impact of the city's rich and varied arts, cultural and entertainment resources.
(a) The council shall consist of members with broad and varied experiences, skills, expertise and knowledge appropriate to accomplish the council's powers and duties and to ensure representation from diverse geographic areas of the city, practicing artists, major citvwide cultural organizations, neighborhood and community cultural organizations, and the community at-large, including, but not limited to, business, civil and labor organizations.
The mayor shall appoint members of the board as follows:
(4)     rive members from major citywide cultural organizations;
(2) rive members from neighborhood or community cultural organizations;
(3) rive practicing artists; and
f4)     Six lay members from the community at large, including, but not limited to, business and labor.
(b) Eleven members of the council shall constitute a guorum for the purpose of transacting business. In making appointments to the commission, the mayor shall provide representation for all areas of the city on the commission.
(c) Initial appointments made after the effective date of this amendatory ordinance of 2011 shall be made as follows:
(1 ) Seven Fifteen members for one-year terms each; and (2 ) Seven Fifteen members for two-year terms eacht-artd (3 ) Seven members for threes-year terms each.
Thereafter, appointments shall be for tfrree- two-year terms.
The mayor shall designate one member as chairman and one member as vice-chairman.
 
(d) Members shall hold office until their successors are appointed. Members may be appointed for two consecutive terms.
(e) Whenever a vacancy shall occur by reason of death, resignation, expiration of term or other reason, the mayor shall within 90 working days appoint a new member to serve for the remainder of the unexpired term.
2-28-050 Advisory board council- Powers and duties.
The advisory board council may exercise the following powers under this provision:
(a) To survey and assess the assets and resources of all genres of the art community needs of the arts, both visual and performing, within the cjty City of Chicago;
(b) To identify and promote polices and programs in support of expanding the arts and their potential to promote economic development and enrich the quality of life existing legislation, policies and programs which affect the arts and to evaluate their effectiveness;
(c) To identify and encourage the use of local resources for the development and support of the arts and special events;
(d) To report the results of its investigation to the commissioner and to make recommendations thereto based on said investigations.
2-28-060 Compensation.
(a) Employees of the department shall receive such compensation as may be fixed by the city council.
(b) No member of the advisory board council except the chairman may shall receive compensation, but each member may be reimbursed for expenses reasonably incurred in the performance of his duties. The chairman shall receive as compensation an amount as set by the city council in the annual appropriation ordinance.
2-28-070 Advisory board council- Acceptance and use of gifts and grants.
The advisory board council may accept offers of gifts or grants from the United States, the state of Illinois, their agencies or officers, or from any person, firm or corporation of services, equipment, supplies, materials or funds and, with the consent of the commissioner, may expend such receipts on projects which facilitate the performance of its duties under this provision. The commissioner shall make a quarterly report to the mayor and to the city council of all gifts and grants received from any source whatsoever and an accounting of the use of gifts and grants received from any source whatsoever.
SECTION 2. Notwithstanding any provision of the code to the contrary, the term of office of each current member of the cultural affairs advisory board appointed prior to the effective date of this ordinance shall end on the effective date of this ordinance and those members shall no longer hold office.
SECTION 3.  This ordinance shall take effect after its passage and publication.
