BE IT ORDAINED BY THE CITY OF CHICAGO CITY COUNCIL OF:
SECTION 1. Chapter 7-28 of the Municipal Code of the City of Chicago is hereby amended by adding a new Section 7-28-340 as follows:
7-28-340 Unlawful use of recycling drop-off centers.
(a) Definitions.
For the purposes of this section, "City of Chicago recycling drop-off center" or "drop-off center" shall mean any metal container having a capacity of ten cubic yards or greater, that is designated by the department of streets and sanitation I or use in discarding approved recyclable refuse.
(b) Unlawful use and fine.
City of Chicago recycling drop-off centers shall be for the exclusive use of City of Chicago residents or licensed businesses, it shall be unlawful for any person, as defined in Section 1 -4-090 (e), who is not a legal resident of the City or a censed business within the City to discard any refuse In any drop-off center. There shall be a rebuttable presumption that any person who is not a legal resident of the City or a licensed business within the City whose refuse is found inside or around any drop-off center is a person who discarded such refuse or caused such refuse to be discarded in violation of this section. Persons found to be in violation of this section will be fined not less than $100.00 or more than $500.00 depending on the amount of refuse disposed of in violation of this section and frequency of offense.
(c) Notice.
The commissioner of streets and sanitation shall post notice on or near drop-off centers, wherever they are maintained by the department of streets and sanitation, that such drop- off centers are for the exclusive use of city of Chicago residents and that use of such drop-off centers by nonresidents shall constitute an offense punishable by a fine of up to $500.00 for each incident of use.
SECTION 2. This ordinance shall be in full force and effect upon its passage and publication.
