Your Committee on Transportation and Public Way begs leave to report and recommend that Your Honorable Body pass the proposed ordinance transmitted herewith for a grant of privilege in the public way to BERGER FINANCIAL SERVICES,   C/O REALTY & MORTGAGE COMPANY - 02011-6872 to construct,  install, maintain and use five (5)   landscapings on the public right-of-way for beautification purposes adjacent to its premises known as 1100 North Dearborn Street.    This ordinance was referred to the Committee on July 28,
2011.
This recommendation was concurred unanimously by a viva voce vote of the members of the Committee with no dissenting vote.

Be It Ordained by the City Council of the City of Chicago:
SECTION 1. Permission and authority are hereby given and granted to BERGER FINANCIAL SERVICES, C/O REALTY & MORTGAGE COMPANY, upon the terms and subject to the conditions of this ordinance to construct, install, maintain and use five (5) Landscaping(s) on the public right-of-way for beautification purposes adjacent to its premises known as 1100 N. Dearborn St
Said Landscaping(s) at N. Dearborn measure(s):
One (1) at twenty-six point zero eight (26.08) feet in length, and nine point two five (9.25) feet in width for a total of two hundred forty-one point two four (241.24) square feet.
Said Landscaping(s) at N. Dearborn measure(s):
One (1) at forty-two point eight three (42.83) feet in length, and nine point two five (9.25) feet in width for a total of three hundred ninety-six point one eight (396.18) square feet.
Said Landscaping(s) at E. Maple measure(s):
One (1) at sixty-seven (67) feet in length, and five point five (5.5) feet in width for a total of three hundred sixty-eight point five (368.5) square feet.
Said Landscaping(s) at E. Maple measure(s):
One (1) at twenty-two point three three (22.33) feet in length, and five point five (5.5) feet in width for a total of one hundred twenty-two point eight two (122.82) square feet.
Said Landscaping(s) at E. Maple measure(s):
One (1) at twenty-five (25) feet in length, and five point five (5.5) feet in width for a total of one hundred thirty-seven point five (137.5) square feet.
The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk.
Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Planning and Development and Department of Transportation (Division of Project Development).
This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.
The grantee shall pay to the City of Chicago as compensation for the privilege #1094716 herein granted the sum of zero ($.00) per annum in advance.
A 25% penalty will be added for payments received after due date.
The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.
Authority herein given and granted for a period of five (5) years from and after Date of Passage.
