RESOLUTION CALLING ON THE GOVERNOR TO SIGN HB 304
 
WHEREAS, A recent proliferation of products sold in retail stores and at checkout counters that mimic, produce or amplify the same effect as narcotics and other banned substances have caused grave concern; and
WHEREAS, It has been reported that psychotic episodes, withdrawal, and dependence are associated with use of these substances. Based on law enforcement encounters reported directly to DEA, first responders report that individuals who have reportedly smoked synthetic cannabinoids have suffered from intense hallucinations. Moreover, emergency department physicians and toxicologists have reported the adverse health effects associated with smoking herbal incense products laced with these substances; and
WHEREAS, Detailed chemical analyses by DEA and other investigators have found these synthetic cannabinoids spiked on plant material in herbal incense products that are marketed to the general public. Product analyses have found variations in both the synthetic cannabinoid found on the plant material and the amount. The risk of adverse health effects is further increased by the fact that similar products vary in the composition and concentration of synthetic cannabinoids spiked on the plant material; and
WHEREAS, Although ingredients of such substances marked under the names of "Spice" and "K2" have been declared by the United States Drug Enforcement Agency as Schedule I controlled substances under the Controlled Substance Act, it appears that unscrupulous distributors are attempting to skirt the legal requirements of this declaration and are continuing to market over the counter of convenience stores and other outlets these harmful substances that imitate the mind altering effects of narcotics and other illegal substances; and
WHEREAS, On June 24, 2011, HB 3042, a bill passed by both the State of Illinois House and Senate that amends the Illinois Controlled Substances Act to immediately add these synthetic cannabinoids as well as certain cathinone derivatives to the list of Schedule I controlled substances, was sent to Governor Pat Quinn where it currently awaits his signature; and
WHEREAS, It is incumbent that this body urge the Governor to sign this vital piece of legislation immediately; now therefore
BE IT RESOLVED That we, the Mayor and members of the City of Chicago City Council gathered together this 6th Day of July, 2011 AD, do hereby call upon the Honorable Patrick Quinn to expeditiously sign HB3042 that would curtail the proliferation of such substances being now openly marketed that are evidenced to be hazardous to the health and well-being of the community by banning the chemical contents of such products.
BE IT FURTHER RESOLVED That a suitable copy of this resolution be prepared and given to the Honorable Pat Quinn, Governor of Illinois.
