ORDINANCE

WHEREAS, the outbreak ofthe novel coronavirus 2019-ncov, also known as COVID-19, has precipitated a worldwide public health crisis, and,

WHEREAS, Executive Order 2020-10, issued by Governor Pritzker on March 20, 2020, implemented a "stay at home" order, categorizing businesses as essential or non-essential and establishing conditions to encourage employees considered essential to work from home, and

WHEREAS, The City of Chicago has a duty to its residents to ensure that all licensed businesses within the City operate in a manner that does not endanger the health or welfare of workers, customers, or City residents, and

WHEREAS, in this time of crisis we are called upon to evaluate our ordinary and emergency operating procedures, and to better prepare for future crises, now therefore,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. A new section 4-4-311 ofthe Municipal Code ofthe City of Chicago is hereby added with the following language:

4*3-311 Declared disasters and emergency operations

A license may be suspended or revoked for failure to comply with emergency procedures during a disaster or emergency declared by the federal government ofthe United States, the State of Illinois, the County of Cook, or the City of Chicago, within the boundaries of which a licensed business is located.
Licensed businesses shall comply with all orders issued during a declared disaster or emergency by the Governor of Illinois and the Mayor of Chicago within their statutory emergency authority.
In the event of any quarantine, stay at home, shelter in place, work/business closure or hour restrictions, or similar order or orders restricting the movement and/or performance of duties by workers, under which "essential" workers or workers similarly deemed by the relevant order or orders may still perform their duties, businesses employing workers so deemed must provide for all essential workers during the performance of their duties personal protective equipment (PPE) and other safety measures adequate to protect workers from the disaster, including but not limited to:

(1) necessary breathing apparatus for protection against airborne hazards



|1010|sanitary equipment and cleaning facilities adequate to any chemical, bacterial, viral, or biological hazards, including communicable disease
protection from communicable diseases in time of epidemic or other, similar outbreak, including at minimum cloth face coverings, either disposable or washed and disinfected between uses
shelter and protective gear adequate to weather and other natural hazards
environmental controls and/or fire protection equipment adequate to any increased risk of fire

In the event that a licensed business cannot provide personal protective equipment and safety measures adequate to the hazards of the declared disaster, it shall be unlawful for businesses to require employees to continue to perform their duties.

(c) At the direction ofthe Mayor, the Commissioner ofthe Department of Business Affairs and Consumer Protection, the Commissioner ofthe Department of Public Health, and/or the Executive Director ofthe Office of Emergency Management and Communications are empowered in times of declared disaster or emergency to issue additional directives and mandatory emergency measures for licensed businesses continuing to operate during the declared disaster or emergency.
