PUBLIC ALLEY CLOSING
BE IT ORDAINED BY THE, CITY COUNCIL OF THE CITY OF CHICAGO THAT THE FOLLOWING PORTION OF PUBLIC WAY BE CLOSED TO VEHICULAR TRAFFIC:
SECTION 1. THAT PART OF THE 14 FOOT NORTHEAST-SOUTHWEST PUBLIC ALLEY IN BLOCK 46 IN THE VILLAGE OF JEFFERSON , A SUBDIVSION OF PART OF SECTION 8, 9 AND 16, TOWNSHIP 40 NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT RECORDED MARCH 29, 1855 IN BOOK 85 OF PLATS, PAGE 101, AND RE-RECORDED SEPTEMBER 27, 1873, AS DOCUMENT NUMBER 128220, IN BOOK 6 OF PLATS PAGE 27, LYING SOUTHEAST OF THE SOUTHEAST LINE OF LOT 8 IN THE VILLAGE OF, JEFFERSON; LYING SOUTHWEST OF A LINE DRAWN FROM THE MOST EASTERLY CORNER OF SAID LOT 8 TO THE MOST NORTHERLY CORNER OF LOT 9 IN THE VILLAGE OF JEFFERSON SAID LINE ALSO BEING THE SOUTHWESTERLY LINE OF N. MILWAUKEE AVENUE; LYING NORTHWEST OF THE NORTHWEST LINE OF SAID LOT 9; AND LYING NORTHEAST OF A LINE 54 FEET SOUTHWEST AND PARALLEL WITH THE SOUTHWEST LINE OF N. MILWAUKEE AVENUE AFORESAID, IN COOK COUNTY, ILLINOIS, CONTAINING: 756 SQ. FT. OR 0.02 ACRES MORE OR LESS as shaded and legally describe^ by the words "HEREBY CLOSED" on the plat hereto attached as Exhibit A, which plat for greater certainty, is hereby made a part of this ordinance, be and the same is hereby closed to vehicular traffic inasmuch as the same is intended for public pedestrian use, and the public interest will be subserved by such closing.
SECTION 2. The closure herein contemplated is made with the express condition that all utilities as currently situated in the public way herein closed to vehicular traffic, shall have unimpeded ingress and egress for the repair and maintenance of their facilities, and that no permanent structures or trees shall be place over said facilities, or current grades changed without the express review and written pre-approval of both the involved respective utilities, and the Commissioner of Transportation. '
SECTION 3. The closure herein provided for! is made upon the express condition that all improvements made to the area to be closed shall be fully permitted, impermanent, removable, and that the alley be returned to original condition in accordance with the most current version of the Chicago Department of Transportation's Regulations for Opening Repair and Construction in the Public Way and its appendices, in the event that it is reopened to vehicular public traffic. SECTION 4. This ordinance shall take effect and be in force from and after its passage and publication. i
