SUBSTITUTE ORDINANCE


WHEREAS, the Annual Appropriation Ordinance for the year 2017 of the City of Chicago (the "City") contains estimates of revenues receivable as grants from agencies of the state and federal governments and public and private agencies; and

WHEREAS, in accordance with Section 8 of the Annual Appropriation Ordinance, the heads of various departments and agencies of the City have applied to agencies of the state and federal governments and public and private agencies for grants to the City for various purposes; and

WHEREAS, the City through its Mayor's Office has been awarded private grant funds in the amount of $125,000 by the Joyce Foundation which shall be used for the Gun Violence Prevention Program; and

WHEREAS, the City through its Mayor's Office has been awarded private grant funds in the amount of $25,000 by the Joyce Foundation which shall be used for the Community Policing Program; and

WHEREAS, the City through its Mayor's Office has been awarded private grant funds in the amount of $158,000 by the John D. and Catherine T. MacArthur Foundation which shall be used for the Police Reform Initiative Program; and

WHEREAS, the City through its Department of Public Health ("Health") has been awarded federal grant funds in the amount of $51,000 from the United States Department of Health and Human Services, Centers for Disease Control and Prevention ("CDC") which shall be used for the Adult Viral Hepatitis Program; and

WHEREAS, the City through Health has been awarded additional federal grant funds in the amount of $27,000 by the Illinois Department of Human Services which shall be used for the Breastfeeding Peer Counseling Program; and

WHEREAS, the City through Health has been awarded private grant funds in the amount of $50,000 by the Public Health Institute of Metropolitan Chicago ("PHIMC") which shall be used for the Data Across All Sectors for Health (DASH) Program; and

WHEREAS, the City through Health has been awarded private grant funds in the amount of $22,000 by PHIMC which shall be used for the Health Chicago 2.0 Program; and

WHEREAS, the City through Health has been awarded 2016 federal carryover grant funds in the amount of $1,096,000 from CDC which shall be used for the Immunization and Vaccines for Children Program; and
WHEREAS, the City through Health has been awarded federal grant funds in the amount of $244,000 from the CDC which shall be used for the Teen Prevention Evaluation Program; and

WHEREAS, the City through Health has been awarded additional carryover federal grant funds in the amount of $100,000 from the CDC which shall be used for Zika Surveillance Program; and

WHEREAS, the City through its Mayor's Office for People with Disabilities ("MOPD") has been awarded public grant funds in the amount of $142,000 from the Chicago Housing Authority ("CHA") which shall be used for the CHA Home Modification Program; and

WHEREAS, the City through MOPD has been awarded public grant funds in the amount of $4,000 from PACE, the Suburban Bus Division of the Regional Transportation Authority, which shall be used for the Disabled Youth Employment Program; and

WHEREAS, the City through its Department of Police ("Police") has been awarded additional federal grant funds in the amount of $58,000 by the United States Department of Justice which shall be used for the Community Policing Development Program; and

WHEREAS, the City through Police has been awarded federal grant funds in the amount of $159,000 by the United States Department of Homeland Security which shall be used for the Port Security Program; and
WHEREAS, the City has received $400,000 (the "LLC Funds") from 845 West Madison, LLC, an Illinois limited liability company (the "LLC"), in satisfaction of certain obligations of the LLC's predecessors pursuant to redevelopment agreements between the City, through its Department of Planning and Development, and the LLC's predecessors for the redevelopment of certain parcels conveyed by the City; and

WHEREAS, it is necessary to amend the Annual Appropriation Ordinance to account for the LLC Funds, not previously appropriated and to be used to provide assistance under the Business Assistance Program of the City's Department of Business Affairs and Consumer Protection; now, therefore,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. The sum of $2,261,000 not previously appropriated, representing new and carryover grant awards, is hereby appropriated from Fund 925 - Grant Funds for the year 2017. The Annual Appropriation Ordinance as amended is hereby further amended by striking the words and figures and adding the words and figures indicated in the attached Exhibit A which is hereby made a part hereof.

SECTION 2. The sum of $400,000 not previously appropriated is hereby appropriated from Fund 100 - Corporate Fund for the year 2017. The Annual Appropriation Ordinance as amended is hereby further amended by making the following changes in Fund 100 - Corporate Fund, 070 -Department of Business Affairs and Consumer Protection: (a) in line item 0135, "For Delegate Agencies," replacing"3,357,039" with "3,757,039;" (b) in line item 0100, "Contractual Services -Total*," replacing "$4,517,757" with "$4,917,757" and (c) in "Appropriation Total*," replacing $18,361,601" with "$18,761,601."

SECTION 3. To the extent that any ordinance, resolution, rule, order or provision of the Municipal Code of Chicago, or part thereof, is in conflict with the provisions of this ordinance, the provisions of this ordinance shall control. If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this ordinance.

SECTION 4. This ordinance shall be in full force and effect upon its passage and approval.

Your Committee on the Budget and Government Operations, having had under consideration an Ordinance authorizing a supplemental appropriation and an amendment to the year 2017 Annual Appropriation Ordinance necessary to reflect an increase in the amount of funds received from Federal, State, public, and/or private agencies, and having been presented with a proposed Substitute Ordinance by the Office of Budget and Management; and having had the same under advisement, begs leave to report and recommend that Your Honorable Body pass the Substitute Ordinance transmitted herewith.

This recommendation was concurred in by a viva voce vote of the members of the Committee.
