ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. Chapter 4-8 of the Municipal Code of Chicago is hereby amended by adding a new Section 4-8-300, as follows:
4-8-300 Retail food establishments - drive-through facilities.
For purposes of this section, the term "drive-through facility" means any service window, automated device or other facility that is used to deliver any article of food or drink sold at retail to individuals in a motor vehicle.
Any retail food establishment that has a drive-through facility must keep open the parts of its establishment that are normally accessible to walk-in customers at all times that it serves or sells food or drink in its drive-through facility.
Any person who violates this section shall be fined not less than $500.00 nor more than $1,000.00 for each offense. Each day such violation continues shall constitute a separate and distinct offense.
SECTION 2. This ordinance shall take effect 10 days after its passage and publication.
