ORDINANCE
SECTION 1. Section 10-8-400 of the Municipal Code of Chicago is hereby amended by inserting the language underscored and by deleting the language as struck through as follows:
10-8-400 Barbed wire, razor wire and interior electric security fences.
No person shall build, construct, use or maintain any fence or barrier consisting or made of what is called "barbed wire", or of which barbed wire is a part, within the city, along the line of, or in, or upon, or along, any public way; or through, along, or around, any public park; or in and about or along any land or lots or parks owned or controlled by the city. Provided, that nothing in this subsection shall be construed to prevent the use or maintenance of barbed wire in or on that part of any such fence or barrier which is higher than six fee from the surface of the public way, public park, lot or park owned or controlled by the city, and wholly on or over private property.
No person shall build, construct, use or maintain any fence or barrier consisting or made of what is called "razor wire", or of which razor wire is a part, within the city, along the line of, or in, or upon, or along, any public way; or through, along, or around, any public park; or in and about or along any land or lots or parks owned or controlled by the city. Provided, that nothing in this subsection shall be construed to prevent the use or maintenance of razor wire in or on that part of any such fence or barrier or structure that secures a government building, a public transit facility, or a public utility facility.
Whenever in the city, in, along or through any public way or park, barbed wireA er-razor wire or interior electric security fencing is found in use in part or in whole for a fence or barrier, except as in this section permitted or as permitted under Section 13-96-120 and 13-96-165 of the Municipal Code of Chicago, the same shall forthwith be removed by the commissioner of transportation.

SECTION 2. Section 13-96-120 of the Municipal Code of Chicago is hereby amended by inserting the language underscored and by deleting the language as struck through as follows:
13-96-120 General requirements.
Fences shall comply with the provisions of sections 13-96-130 to 13 96 160, 13-96-165, inclusive.
SECTION 3. Section 13-96-165 of the Municipal Code of Chicago is hereby added by inserting the language underscored as follows:
13-96-165 Interior Electric Security Fence.
A. The construction, maintenance and use of interior electric security fences shall be permitted within the city corporate limits subject to the following standards:

1. Unless otherwise specified, interior electric security fences shall be constructed
or installed in conformance with the specifications set forth in the International Electrotechnical Commission (IEC) Standard No. 60335-2-76 and with any applicable standards of the City of Chicago Building Code.

2. Electrification

a. The energizer for interior electric security fences may not exceed twelve
(12) volts DC.

b. The electric charge produced by the interior electric security fence shall
operate on DC pulsed current and shall not exceed energize characteristics set forth in paragraph 22.108 and depicted in Figure 102 of IEC Standard No. 60335-2-76.

3. Perimeter fence or wall, and temporary electric security fencing:
a. No interior electric security fence shall be installed, maintained, or used
unless it is completely surrounded by a non-electrical fence or wall that is not less than five feet. The security fence must be at least two feet higher than the perimeter fence.

b. Interior electric security fencing may be temporary in nature, but shall
otherwise be constructed, maintained and used only as permitted by this section.

4. Location.

a. Interior electric security fences shall be permitted on any property that does not have a permitted residential use, including but not limited to properties zoned as residential mixed use.

5. Warning Signs.

Interior electric security fences must be clearly identified with warning signs that read: "Warning - Electric Fence" posted at intervals of not less that every thirty (30) feet in English and Spanish and any other language that the Commissioner of the Department of Buildings deems necessary to protect the public.

B. It shall be unlawful for any person to install, maintain or operate an interior electric security fence in violation of this section. Any person violating this section shall be fined $500 per offense.

SECTION 4. This ordinance shall be in full force and effect 180 days after its passage and publication.
