ORDINANCE

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

 

SECTION 1.  The former City of Chicago Department of the Environment is hereby reestablished. Those sections of Article II of SO2011-8885 that abolished the Department ofthe Environment and transferred the powers and duties ofthe Commissioner ofthe Environment to other agencies and departments of the City of Chicago are hereby repealed in their entirety, and all such powers and duties that have not otherwise been repealed are hereby restored to the Commissioner of the Environment.

 

SECTION 2.  All rules or regulations promulgated by an agency or department of the City of Chicago regarding powers and duties formerly held by the Commissioner ofthe Environment shall remain in effect until amended or repealed by the Commissioner ofthe Environment in the exercise of the Commissioner's authority.

 

SECTION 3.  All actions taken by an agency or department of the City of Chicago in the exercise of powers and duties formerly held by the Commissioner ofthe Environment shall not be invalidated by this Ordinance. Such agencies and departments shall continue to exercise these powers and duties until an orderly transfer of such powers and duties can be made to the Commissioner ofthe Environment.

SECTION 4. The reestablishment of the Department of the Environment is contingent upon passage of an amendment to the 2019 Annual Appropriation Ordinance that provides for such department.

,SE,CTION 5.  This ordinance shall take effect 10 days following passage and publication, Upon becoming effective, the Department ofthe Environment shall be reestablished promptly and in a coordinated fashion, with full implementation to be achieved as soon as possible after July 1, 2019, and no later than OctpbeTTT2019.
