ORDINANCE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. Chapter 8-4 ofthe Municipal Code of Chicago is hereby amended by adding a new section 8-4-160, as follows:

8-4-160 Facilitation of an unlicensed business.
For purposes of this section the following definitions apply:

"Short-term rental facilitator" means a person, who for compensation or a fee, uses an internet-enabled application or digital platform to connect a guest with a person who offers for rent or hire a vacation rental, as that term is defined in section 4-6-300, a bed and breakfast, as that term is defined in section 4-6-290, or hotel, as that term is defined in section 4-6-180, or any portion thereof, for transient occupancy, as that term is defined in section 4-6-290.

"Guest" means a person who rents or hires a vacation rental, a bed and breakfast, or a hotel, or any portion thereof, for transient occupancy by the guest. The term "guest" does not include members of the vacation rental, bed and breakfast or hotel owner's household, as that term is defined in section 17-17-0270.
It shall be unlawful for any short-term rental facilitator to list for rent or hire any vacation rental, bed and breakfast or hotel, or any portion thereof, unless the vacation rental, bed and breakfast or hotel has a valid license under the appropriate licensing category.
It shall be unlawful for a short-term rental facilitator to list on its internet-enabled application or digital platform a vacation rental, bed and breakfast or hotel for rent or hire without listing the license number for the vacation rental, bed and breakfast or hotel.
Any person who violates any provision of this section shall be subject to a fine of not less than $1,000.00 nor more than $3,000.00 for each offense. Each day that such violation exists shall constitute a separate and distinct offense.
