ORDER CITATION FOR CONTEMPT

WHEREAS, pursuant to the Illinois Municipal Code the Chicago City Council is a body charged with the authority to investigate matters pertaining to its ordinances, rules, regulations and its officers and employees; and

WHEREAS, central to this power is the City's ability to conduct effective hearings; and

WHEREAS, such a hearing was called for by a City Council July 26, 2017 order that the Commissioner of Aviation appear before the Joint Committee on Aviation and Committee on Finance to address problems with windows installed as part of the Residential Sound and Insulation Program; and

WHEREAS, a hearing pursuant to the order was noticed for August 23, 2017 at 3:00 p.m. in the gymnasium of Hale Park, located at 6258 West 62nd Street, Chicago, Illinois; and

WHEREAS, a public notice and agenda for the hearing were posted and filed with the City Clerk on August 14, 2017 and August 15, 2017, respectively; and

WHEREAS, the Commissioner failed to appear at said hearing; and

• WHEREAS, the City Council finds that its authority as a legislative and investigative body is curtailed when members ofthe City's own administration fail to cooperate with the fact finding process afforded by public hearings; and

WHEREAS, such an obstruction in a legal setting may elicit a finding of contempt within the applicable jurisdiction and venue; and

WHEREAS, to sustain a contempt charge, there must be a valid order, knowledge of the order, and disregard of the order; and

WHEREAS, on July 26, 2017, an order was entered seeking Commissioner Ginger Evans to appear before the City Council Joint Committee on Aviation and Committee on Finance, a public notice issued for the hearing, and Commissioner Ginger Evans failed to appear, thereby satisfying all of the elements of a contempt charge; now, therefore,

BE IT ORDERED BY THE CITY OF COUNCIL OF THE CITY OF CHICAGO:
