ORDINANCE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. Section 9-68-060 ofthe Municipal Code is hereby amended by inserting the language underscored, as follows:

9-68-060 Service vehicle permits - Restrictions.

Subject to and in accordance with the procedures and requirements described in Sections 9-68-060 through 9-68-100, the commissioner of transportation may issue permits for parking contrary to general parking regulations however, such permit shall not allow parking contrary to the regulations described in Section 9-40-060 ofthis Code. Permits issued under this program may be issued only for vehicles ofthe second division, as defined in the Illinois Motor Vehicle Code, as amended. Permits may be issued only to the following types of vehicles:

SECTION 2. Section 9-68-100 ofthe Municipal Code is hereby amended by inserting the language underscored, as follows:

9-68-100 Violation - Penalty.
No permit issued under Section 9-68-070 shall be altered, defaced, or transferred from one vehicle to another or from the applicant to any other person.
At the direction of a police officer or member of the fire department, a.vehicle properly displaying a permit issued under Section 9-68-070 shall be removed in order to allow access to a fire hydrant or allow for the free-flow of traffic on a street path or lane designated for the use of bicycles.
The commissioner of transportation shall revoke a permit issued to any person who violates subsection (a) or subsection (b) of this section, or of any person who violates Section 9-40-060 or Section 10-8-272 of this Code, or who misrepresents or falsifies any information in order to obtain the permit.
Any person who violates subsection (a) or (b) of this section, or who misrepresents or falsifies any information in order to obtain a permit under Section 9-68-070, or interferes with the administration of this permit program by the commissioner of transportation, shall be fined $200.00 for each offense. Each day that a violation continues shall constitute a separate and distinct offense.


SECTION 3. Section 9-92-030 ofthe Municipal Code is hereby amended by inserting the language underscored, as follows:

9-92-030 Authority to impound or otherwise relocate vehicle.
Members of the Police Department and employees of the Department of Streets and Sanitation, and employees ofthe Department of Aviation with respect to violations occurring at

O'Hare International Airport, and employees of the Department of Finance with respect to (b) through (f) of this section, are authorized to issue a notice of parking violation and may authorize the removal of a vehicle from any public way to a City vehicle pound or authorized garage or other legal parking space in the public way under the following circumstances:
When a vehicle upon any public way is so disabled as to constitute an obstruction to traffic and the person or persons in charge of the vehicle are by reason of physical injury incapacitated to such an extent as to be unable to provide for its custody or removal;
When an unattended vehicle is unlawfully parked so as to constitute a hazard or obstruction to the normal movement of traffic;
When an unattended vehicle is parked, stopped, or standing in violation of Section 9-40-060, 9-64-020; 9-64-050, 9-64-070, 9-64-100, 9-64-110, 9-64-120, 9-64-130(b), 9-64-140(b), 9-64-150(b), 9-64-160(b), 9-64-165(f), 9-64-170, 9-64-210, 9-80-080(a), or 9-80-130;
When a vehicle has been abandoned or found to be a hazardous dilapidated motor vehicle in violation of Section 9-80-110;
When a vehicle illegally occupies a parking meter space for more than 24 hours;
When an unattended vehicle is parked illegally in an officially designated and marked "tow zone;"
When a vehicle is in violation of any provision of the traffic code authorizing towing and impoundment for that violation;
When a vehicle is subject to towing or removal under the Illinois Vehicle Code, the Criminal Code of 1961, or any other law;

(i) When towing or removal is necessary as an incident to an arrest.


SECTION 4. Section 10-8-272 ofthe Municipal Code is hereby amended by deleting the language struck through and inserting the language underscored, as follows:

10-8-272 Reserved. Closure of bicycle lanes.

When anv permit issued by anv Citv department or agency or anv work in the public way results in the closure of a bicycle lane, signs must be provided warning bicyclists of the lane closure and warning vehicles of the need to yield to the bicyclists. The signs must be of a type as designated by the department of transportation. At a minimum, the lane closure signs must be located on both sides of the street in the direction of the approach to such closure at the preceding intersection and, if the closure is located more than 400 feet from such intersection, at a point 300 feet in front of such closure. In addition, lane closure signs must be at the site of such closure facing the approaching bicycle traffic. At a minimum, the yield to bicyclist signs must be located on both sides of the street in the direction of the approach to such closure at a point 100 feet and 50 feet in front of such closure. In addition, yield to bicyclist signs must be at the site of such closure facing the approaching bicycle traffic. The permittee or other person responsible for the bicycle lane closure is responsible for maintaining the signs for the duration of the closure, and shall, at a minimum, post a notice of a type as designated bv the department

of transportation at least 24 hours in advance of such closure at the site of the closure. The requirement to post such notice 24 hours in advance of the closure mav be waived in the case of a bona fide emergency. Anv person violating this section may be fined between $500 and $1.000. and mav be subject to permit revocation pursuant to Section 9-68-100 of this Code.


SECTION 5. Section 10-28-284 of the Municipal Code is hereby amended by deleting the language struck through and inserting the language underscored, as follows:

10-28-284 Closure of sidewalks and bicycle lanes.
(A) Closure of sidewalks. When the use of a construction canopy results in the total closure of a sidewalk, signs must be provided warning pedestrians that the sidewalk is closed. The signs must be printed in a type size no less than 4 inches in height, must be located at appropriate adjacent intersections and must also be attached to both sides of the construction canopy. The permittee is responsible for maintaining the signs for the life of the construction project.
—(B)—Closure of bicycle lanes. Whon tho use of q construction canopy results in tho closure of a bicycle lane, signs must be provided warning bicyclists of the lane closure and warning vohiolos of thc nood to yield to tho bicyclists. Tho signs must be of a typo aa designated by tho dopartmont of transportation. At a minimum, tho lane closure signs must bo located on both sides of the street in the direction of the approach to the construction canopy at a point 600 foet and 300 feet in front of tho construction canopy. In addition, lano closure signs must bo attached to tho end of tho construction canopy facing tho approaching bicyclo traffic. At a minimum, tho yield to bicyclist signs mu3t be located on both sides of the street in the direction of the approach to tho construction canopy at a point 100 foot and 50 foot in front of tho construction canopy. In addition, yiold to bicyclist signs must bo attached to tho ond of tho construction canopy facing thc approaching bicycle traffic. The permittee is responsible for maintaining the signs for tho life of tho construction project.


SECTION 6. This ordinance shall take effect 10 days after passage and publication.
