BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION L Section 9-68-020 ofthe Municipal Code ofChicago is hereby amended by deleting the language stricken through and by inserting the language underscored, as follows:

9-68-020 Residential parking permits.

(a)(1) Upon application and payment of the required fee to the city clerk, the clerk or his the clerk's designee shall issue annual "residential parking permit" stickers to residents ofthe residential parking permit zone for use on each car owned and registered within any residential parking permit zone, displaying a current city wheel tax license emblem. Such a residential parking permit sticker may also be issued as part of such city wheel tax license emblem. Such a residential parking permit sticker shall be affixed, in accordance with the instructions printed thereon and without the use of supplemental adhesives, at the lower right-hand corner of the inside of the glass portion of the windshield of such motor vehicle, directly above or as part of the city wheel tax license emblem. This permit sticker shall not guarantee or reserve any parking space, nor shall it exempt the holder from the observance of any traffic or parking regulation.

(2) Upon application and payment of the required fee to the city clerk, the clerk or the clerk's designee shall issue a "professional service parking permit" sticker to a person who has been issued a current and active real estate broker, real estate salesperson, or real estate leasing agent license by the State of Illinois for use on one vehicle owned and used within any residential parking pennit zone for business purposes pursuant to the relevant professional license. The clerk may issue a professional service parking permit sticker for a term of up to 24 months. The applicant shall provide the clerk satisfactory evidence that the applicant has no debt due and owed to the City of Chicago at the time of application. No more than one professional service parking sticker may be issued to anv one person. The professional service parking permit sticker shall be affixed, in accordance with the instructions printed thereon and without the use of supplemental adhesives, at the lower right-hand corner of the inside of the glass portion of the windshield of such motor vehicle, directly above the city vehicle tax sticker, when applicable. This permit sticker shall not guarantee or reserve any parking space, nor shall it exempt the holder from the observance of any traffic or parking regulation.

(a) The annual fee for a professional service parking permit sticker is $500.00 for a vehicle owned by a Chicago resident and $800.00 for a vehicle owned by a non-resident of Chicago; however, these fees shall be adjusted starting in 2018 and every two years thereafter by applying to it the rate of inflation calculated based on the Consumer Price Index - Urban Wage

 

 

Earners and Clerical Workers (Chicago All Items) published by the United States Bureau of Labor Statistics, as calculated by the Comptroller, communicated to the Clerk by the Comptroller, and published by the Clerk. Provided further, that the amount of any such adjustment shall be capped at 105% of the fee being adjusted.

Whenever the owner of any vehicle licensed under this section, before the expiration of such license, sells or otherwise disposes of such vehicle, and thereafter acquires another vehicle and desires to transfer the professional service parking permit sticker originally issued for the vehicle disposed of, to such newly acquired vehicle, such owner shall immediately make application to the city clerk for a transfer of said vehicle license to the newly purchased vehicle-Said application shall state the name and address of the permit holder and the name and address of the purchaser of said vehicle, together with a description of the newly purchased vehicle. Upon surrender of the original professional service parking permit sticker or upon proof that the professional service parking permit sticker has been destroyed, the city clerk or the clerk's designee shall transfer said permit to apply to the newly acquired vehicle upon payment ofthe proper fee, provided, that the city clerk or the clerk's designee shall not transfer any sticker when the professional service parking permit sticker is defaced or mutilated so as to prevent identification of the sticker. It shall be unlawful for any person to display a professional service parking permit sticker on anv vehicle other than the vehicle for which the sticker was originally issued, without first transferring the license to such other vehicle, as provided for herein. The transfer fee shall be $20.00.

The professional service parking permit sticker shall only be issued for use on a vehicle classified as a "passenger automobile", a "larger passenger automobile", or a "small truck or other vehicle", as those terms are defined by the city clerk in duly promulgated rules. Such sticker shall be valid from the time of issuance and display until the last day of the month indicated on the face of the sticker, only when the vehicle is being used for business purposes pursuant to the relevant professional license between the hours of 9:00 a.m. and 9:00 p.m. At all other times, the sticker shall be of no force or effect. In addition, the sticker shall be of no force or effect when parking restrictions are in place within: the Wrigley Field neighborhood permit parking program established by sections 9-64-041, 9-68-022, and 9-68-023; the Soldier Field area parking program area established by Section 9-68-025; and the Comiskey Park neighborhood parking program established by Section 9-68-026:

It shall be the duty of the license holder to provide written notification to the city clerk within 10 days of the suspension, revocation, or expiration of the relevant professional license or certification that is the basis for issuance of the sticker. At the time of such suspension, revocation, or expiration, the sticker shall cease to be valid and must be removed by the holder of the sticker. Notwithstanding subsection (i) of this section, any person displaying the professional service parking permit sticker issued pursuant to this paragraph (a)(2) after suspension, revocation, or expiration of the relevant professional license that is the basis for issuance of the

 

sticker shall be fined not less than $750.00 nor more than $1,500.00 for each offense, and each day such a violation continues shall be deemed a separate and distinct offense.

Any person displaying the professional parking permit sticker issued pursuant to this paragraph (a)(2) in a residential zone for purposes unrelated to business pursuant to their relevant professional license shall be fined in accordance with 9-64-090(d) and 9-64-090(e). In the event anv person receives two final determinations of violations of this subsection, their sticker shall cease to be valid and must be removed by the holder of the sticker. Any person who fails to remove a professional service parking permit sticker as required by this subsection shall be fined not less than $200.00 nor more than $500.00 for each offense, and each day such a violation continues shall be deemed a separate and distinct offense.

The city clerk is authorized to promulgate rules to effectuate the purpose of this subsection (a)(2).

This subsection (a)(2) shall be repealed of its own accord, and shall be of no force and effect, on December 31, 2017 and thereafter; however, any professional service parking permit sticker issued pursuant to this paragraph (a)(2) prior to December 31, 2017 shall be valid until the expiration date printed on the sticker.
